Moraleja annuls architect position after ruling on an appeal for reconsideration
Por FactBox Admin

The Moraleja City Council has annulled the regulatory bases and the call for selective tests to fill a vacant Architect position within its labor staff, and has declared the procedure concluded and archived. This was agreed upon by Mayoral Resolution No. 2026-0996, of October 28, 2026, which upholds the appeal for reversal filed against the process and is published in the Official Gazette of the Province of Cáceres No. 0212, of November 5, 2026 (CVE: BOP-2026-5164, pages 24897-24898).
The appeal that changes the process
The origin of the decision is the appeal for reversal filed on October 13, 2026, under registration number 2026-E-RE-910, against the bases and the corresponding call for selective tests. The Mayoral resolution fully upholds this challenge and, as a consequence, nullifies the procedure that had been initiated by the Council itself.
The annulled bases had been approved by Mayoral Resolution No. 727, of August 10, 2026, and the call was published in the Official Gazette of the Province of Cáceres No. 0158, of August 19, 2026. Less than three months have passed between the publication of the announcement and the resolution now disseminated, and barely fifteen days between the filing of the appeal and its approval.
Four agreements: annulment, archiving, refund of fees, and notification
Resolution No. 2026-0996 specifies its decision in four points:
- Annul the regulatory bases and the call for the selective procedure convened for the provision of an Architect position.
- Declare concluded and archive the selective procedure.
- Refund ex officio the amounts paid as examination fees to the applicants who had submitted their application for participation.
- Formally notify the resolution to those who hold the status of interested parties in the procedure.
The refund of fees is carried out ex officio, meaning without the need for applicants to claim it, which affects all persons who completed their registration in the process.
Appeal process and effects
Against this resolution, which exhausts the administrative route, no new administrative appeal for reversal may be filed. Interested parties wishing to challenge it must go directly to the contentious-administrative jurisdiction, before the competent Contentious-Administrative Court, within a period of two months starting from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
The announcement appears signed in Moraleja on October 29, 2026, by the mayor-president, Julio César Herrero Campo, and is inserted in Section I (Local Administration, City Councils) of the provincial bulletin.
The closure of the process leaves the architect position vacant in the municipal staff, meaning the City Council must decide whether to launch a new call with corrected guidelines. For the applicants, the immediate consequence is twofold: the annulment of all actions in the process and the recovery of the fees paid, while the possibility of appealing before the courts remains open.
