Montgai approves the construction waste management ordinance

The Montgai City Council has definitively approved the Municipal Ordinance for the Management of Construction Waste, which will require builders and individuals to manage the soil and rubble generated in works within the municipality in a controlled manner. The regulation, processed under file 70/2025, is published in the Official Gazette of the Province of Lleida (no. 167, of September 1, 2026, edict 7401, CVE BOP-2026_0_167_7401, pp. 1-8).
The initial plenary agreement was adopted on June 19, 2025 and, as no claims were filed during the public exhibition period, the Plenary made it definitive in the ordinary session of November 6, 2025. The vote obtained 6 votes in favor, none against and none abstaining, with an excused absence from councilwoman Elisabet Darbra Badia. The ordinance will enter into force 15 business days after its publication in the BOP.
Scope and object of the regulation
The ordinance regulates the controlled management of soil and rubble in demolition, construction, and excavation works, as an additional regulation to the granting of municipal building permits. It is strictly mandatory throughout the entire municipal district of Montgai, which includes the nuclei of Montgai and Butsènit, in the region of la Noguera.
The regulation classifies waste into three types:
- Demolition: materials obtained from the demolition of buildings, installations, and masonry work.
- Construction: waste materials originating from construction activity.
- Excavation: soil, stone, or other materials resulting from the excavation of the ground.
Mandatory deposits and guarantees
The applicant for a building permit must include an assessment of the foreseeable volume of waste in the technical documentation and provide an acceptance document signed by an authorized manager. The amount of the deposit is set at:
- Demolition and construction waste: €12.02/m³, with a minimum of €120.20.
- Excavation waste: €6.01/m³, with a minimum of €300.51 and a maximum of €24,040.48.
When the volume cannot be predicted, the deposit will be calculated based on the project budget with percentages of 0.15% for demolitions and new construction and 0.07% for excavations. The deposit will be returned once the correct management is documented, upon presentation of the manager’s certificate within one month of the completion of the work.
Sanctioning regime
Non-compliance with the ordinance will result in the execution of the deposit by the City Council and the application of the sanctioning regime provided for in Law 6/93, of July 15, regulating waste. Fines range from a minimum of €120.20 up to €6,010.12 for very serious infractions, and infractions are classified as minor, serious, and very serious.
The municipal administration may suspend improper dumping works, require rectifications, order technical measures, and the restoration of degraded spaces. The document, electronically signed by Mayor Jaume Gilabert Torruella on August 31, 2026, is available to interested parties at the City Council’s electronic headquarters.
