Monforte definitively approves a transfer of 72,000 euros between expenditure areas
Por FactBox Admin

The Monforte de Lemos City Council has definitively approved file no. 45/2026 for the modification of credits, in the form of credit transfers between applications of different expenditure areas, for an amount of 72,000.00 euros. The approval became definitive as no claims were registered during the public exhibition period, and it is published in the Official Gazette of the Province of Lugo number 248, corresponding to Thursday, October 29, 2026, in the city councils section, under official reference R. 2951.
The announcement recalls that the file was processed in accordance with article 169 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5, as well as article 20 of Royal Decree 500/1990, of April 20. This is, therefore, an internal credit reallocation operation between different expenditure areas, a figure that does not increase the total volume of the municipal budget but rather shifts allocations from one area to another.
The text sent to the provincial printing office specifies that the plenary agreement in question was adopted in an ordinary session and that, after the public exhibition period passed without allegations, article 38 of Royal Decree 500/1990, of April 20, is applicable, whereby the agreement is understood to be definitively approved without the need for a new pronouncement by the plenary.
A two-phase process and a fifteen-day period
The processing of the file went through two official publications, both in the Official Gazette of the Province of Lugo:
- Announcement of the initial approval of file 45/2026, published in number 225, of October 1, 2026, which opened a public exhibition period of fifteen days starting from the day following the insertion of the announcement.
- Announcement of definitive approval, published in number 248, of October 29, 2026, once it was verified that no claims were presented.
Both publications are signed by José Tomé Roca, mayor of Monforte de Lemos, although the announcements are signed by delegation, according to the decree dated 21.06.2023, by the first deputy mayor, Gloria María Prada Rodríguez. The signature date of the definitive announcement is October 26, 2026.
Plenary approval dates that do not coincide in the two announcements
The two official texts do not agree when specifying the plenary session in which the file was initially approved. The announcement published in October places that initial approval in the ordinary session of September 28, 2026, while the definitive announcement now disseminated refers to a plenary agreement adopted in the ordinary session of March 30, 2026.
The bulletin offers no explanation regarding that difference in dates, nor does it provide the detail of the budget applications of origin and destination for the 72,000.00 euros. The published information limits the economic scope of the operation to the global amount and its nature as a transfer between expenditure areas.
Two-month deadline to appeal to the contentious jurisdiction
The final approval ends the administrative route and opens the possibility of direct challenge before the contentious-administrative jurisdiction. According to the announcement:
- The contentious-administrative appeal can be filed directly, in the form and within the deadlines established by the rules of that jurisdiction, which in practice is equivalent to two months from the day following publication.
- The text does not provide for a prior appeal for reversal (recurso de reposición) via the administrative route.
- Publication in the provincial bulletin produces the effects of notification for the persons interested in the file.
Other municipal matters in the same issue
Issue 248 of the bulletin also includes another announcement from the City Council of Monforte de Lemos, under reference R. 2962, regarding the provisional approval of the modification of fiscal and non-fiscal ordinances. This agreement was adopted in an ordinary plenary session on October 26, 2026, and covers the general ordinance of public law income, that of the tax on the increase in value of urban land, the municipal waste management fee, the municipal swimming pool fee, and the non-fiscal ordinances for drains and water supply. The public exhibition period in this case is thirty business days.
Effect on municipal financing
The operation closes a file that redistributes 72,000.00 euros between expenditure areas of the current budget, such that the beneficiary areas gain execution capacity without altering the total budget figure. For residents and for the groups that work with the Council, the agreement implies that the affected credits can now be committed and executed, once the administrative route of public exhibition has been exhausted.
