Moncofa approves the waste collection and street cleaning ordinance

The Moncofa City Council has definitively approved the Municipal Ordinance for Waste Collection and Street Cleaning, a new regulatory text that establishes the legal regime for these municipal services and the obligations of residents, businesses, and economic activities. The approval is published in the Official Gazette of the Province of Castellón number 100, dated August 20, 2026, with official reference 03744-2026-U.

The regulation was initially approved by Plenary Agreement in the ordinary session of June 25, 2026, and announced in BOP number 79, dated July 2, 2026. As no allegations were submitted during the public exhibition period, the text is definitively approved and will enter into force fifteen days after its full publication in the gazette, in accordance with article 70.2 of Law 7/1985, regulating the Bases of Local Regime.

Adaptation to the circular economy

The new ordinance responds to the need to adapt municipal regulation to the current regulatory framework regarding waste and the circular economy, especially Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, and Law 5/2022, of November 29, of the Generalitat Valenciana, which promotes the circular economy in the Valencian Community.

The text reinforces waste prevention, separation at the source, and the differentiated collection of different fractions, with the aim of reducing the residual fraction and scattered litter. Furthermore, it provides legal coverage for the new service procurement, as required by article 312.1.a) of Law 9/2017, on Public Sector Contracts.

Selective collection by colors and schedules

The ordinance regulates selective collection through containers identified by colors:

• Brown, for the bio-waste fraction (food scraps and small pruning waste).
• Yellow, for light plastic or metal packaging.
• Blue, for paper and cardboard.
• Green, for glass packaging.
• Grey, for the residual fraction, which must be deposited in closed bags.

Generally, waste may be deposited without time limitations, except for the residual and bio-waste fractions, which may only be deposited between 5:00 PM and the passage of the collection truck. The text also regulates the door-to-door collection of paper and cardboard in businesses, the collection of bulky items, pruning waste, and the use of mobile eco-parks.

Sanctioning regime

Infractions are classified as minor, serious, and very serious, with the following sanctions:

• Minor: fine of up to 600 euros.
• Serious: fine of up to 1,500 euros.
• Very serious: fine of up to 3,000 euros.

Infractions include, among others, the abandonment of waste outside of containers, the handling or scavenging of deposited waste, the deposition of waste in containers other than the corresponding fraction, and the abandonment of furniture or household goods outside of the established systems. The ordinance repeals articles 8 to 9, 12 to 15, 21 to 25, 32 to 37, and 43 to 66, as well as Annex I, of the previous Municipal Urban Cleaning Ordinance, approved on January 29, 2009, and published in BOP number 24, dated February 24, 2009.

The document is signed by the mayor by delegation of functions, José María Andrés Alós, via Decree 2026-3361, dated August 10, 2026, dated in Moncofa on August 18, 2026.

The entry into force of this ordinance represents a significant change for the citizens and economic activities of Moncofa, who must adapt their waste separation and deposition habits to a more demanding system aligned with circular economy objectives, under a sanctioning regime that reinforces compliance with the new obligations.
