Mohernando delega en Tráfico las multas por infracciones en vías urbanas

The Mohernando City Council has delegated to the Provincial Traffic Headquarters of Guadalajara the exercise of the sanctioning authority for violations of traffic, motor vehicle circulation, and road safety regulations committed on the urban roads of the municipality. The agreement was adopted by the corporation’s Plenary on September 29, 2026, and is published in the Official Gazette of the Province of Guadalajara, number 197, corresponding to Thursday, October 15, 2026, within the City Councils section. The announcement appears signed in Mohernando, on October 13, 2026, by the mayor, Iván González Calvo.

Lack of own means to sanction

The City Council justifies the decision based on the insufficiency of the means and resources available to effectively exercise the sanctioning power regarding traffic. For this reason, in addition to agreeing to the delegation, the Plenary formally requests that the Provincial Traffic Headquarters of Guadalajara assume the aforementioned municipal competence.

The delegation is supported by Article 84.4 of Royal Legislative Decree 6/2015, of October 30, which approves the Revised Text of the Law on Traffic, Motor Vehicle Circulation, and Road Safety. This regulation allows municipalities that do not have the necessary means to entrust the State Administration with the exercise of their sanctioning powers over traffic on urban land.

What changes in the processing of reports

With the plenary agreement, the competence to instruct and resolve sanctioning proceedings derived from infractions committed on the streets and urban roads of Mohernando will now be exercised by the Provincial Traffic Headquarters of Guadalajara, and not by the City Council itself.

The change affects the processing of reports issued within the municipal district for non-compliance with circulation, road safety, and motor vehicle regulations on urban roads. The City Council thus ceases to solely handle a procedure for which it declares it does not have sufficient resources.

  • Delegating body: the Plenary of the Mohernando City Council.
  • Date of agreement: September 29, 2026.
  • Body assuming competence: the Provincial Traffic Headquarters of Guadalajara.
  • Material scope: violations of traffic, motor vehicle circulation, and road safety regulations.
  • Territorial scope: the urban roads of the municipality of Mohernando.
  • Alleged reason: insufficiency of municipal means and resources.

The public disclosure of the agreement is carried out in accordance with the provisions of Article 9.3 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, which requires the publication of delegations of competencies between administrations in the corresponding official gazette.

The announcement is inserted in the City Councils section of the Official Gazette of the Province of Guadalajara number 197, dated October 15, 2026, and is assigned the verification code e1bba7617d3f061cfdf5e4440f09d734edfd1b3f, available through the electronic office of the Provincial Council.

Impact for residents

The measure transfers the sanctioning response for traffic violations committed in the urban center of Mohernando—a municipality in the province of Guadalajara that acknowledges it cannot sustain this task on its own—to the State Administration. For residents, the processing of a traffic report on urban roads will no longer be resolved at the City Council and will instead depend on the Provincial Traffic Headquarters of Guadalajara, which assumes the investigation and resolution of the procedures.
