Miajadas approves the agreement with Mercadona for access to the EX-102

The Plenary of the Miajadas City Council has definitively approved the collaboration agreement with the commercial company Mercadona, SA to execute the access project for its new commercial facilities on the right bank of the EX-102. The agreement, which exhausts the administrative route, is published in the Official Gazette of Extremadura (DOE) no. 194, of October 7, 2026, via an announcement dated September 28, 2026, with official reference 2026081658.

The purpose of the agreement is the execution of the “Access project to new commercial facilities on the right bank of the EX-102, via a service road between pk 0+050 – pk 0+300 and an underground crossing of the LMT pk 0+080”, in the municipality of Miajadas (Cáceres). The publication is carried out in accordance with Decree 143/2021, of December 21, which approves the General Regulations of the Law on sustainable territorial and urban planning of Extremadura.

A 250-meter service road and an underground crossing

The projected action comprises the following technical elements:

• A service road on the right bank of the EX-102, between kilometer points 0+050 and 0+300, representing approximately 250 meters of layout.
• An underground crossing of a medium-voltage line (LMT) at kilometer point 0+080.
• The area is located entirely within the municipality of Miajadas, in the province of Cáceres.

From initial to definitive approval

The processing of the file took place in two extraordinary plenary sessions:

• On July 29, 2026, the Plenary initially approved the agreement, which was submitted for public consultation through its publication in the Official Gazette of the Province of Cáceres (BOP) no. 152, of August 7, 2026.
• On September 25, 2026, the Plenary, meeting again in an extraordinary capacity, definitively approved the collaboration agreement between the Miajadas City Council and Mercadona, SA.

Deadlines and means of appeal

Against the agreement, which exhausts the administrative route, interested parties have the following options:

• Optional appeal for reversal (recurso potestativo de reposición), within one month from the day following the receipt of the notification, before the body that issued the resolution, in accordance with articles 123 and 124 of Law 39/2015, of October 1.
• Contentious-administrative appeal, within two months, before the Contentious-Administrative Court of Cáceres, according to article 46 of Law 29/1998, of July 13.
• If the appeal for reversal is chosen, the contentious-administrative appeal cannot be filed until the former is expressly resolved or dismissed by administrative silence.

The announcement is signed in Miajadas, on September 28, 2026, by the Mayor-President, Antonio Díaz Alias.

The final approval clears the last administrative formality of the agreement and opens the way for the execution of the road that will serve the new commercial facilities of Mercadona, SA on the right bank of the EX-102. For the municipality, the agreement means organizing vehicular access to a growing commercial area and resolving the connection with the regional highway through a service road and an underground medium-voltage crossing, with the consequent effect on mobility and local economic activity.
