Commercial Court 2 of Valencia opens the micro-enterprise proceedings for Omsuntech
Por FactBox Admin

The Commercial Court No. 2 of Valencia has agreed to open the special procedure for micro-enterprises for Omsuntech Sociedad Limitada, a company that is currently in a state of insolvency. The resolution is issued within the framework of insolvency proceeding 960/2024, which is now final, and is published in the Official Gazette of the Mercantile Registry (BORME) number 208, corresponding to Wednesday, October 28, 2026, with the official reference BORME-A-2026-208-46 and entry number 483191.
The announcement specifies that the order declaring the insolvency is dated November 11, 2024, and is being processed as a voluntary insolvency. The competent judicial body is the Commercial Court No. 2 of Valencia, presided over by Judge Jacinto Talens Segui. The annotation was made on October 21, 2026, and appears on the company’s registration sheet, opened in the Mercantile Registry of Valencia with the data S 8, H V 205734, I/A 5.
Current insolvency and opening for liquidation
The published text states that the company “is in a state of current insolvency,” meaning it is unable to regularly meet its enforceable obligations, and that the special procedure for micro-enterprises is opened directly in the liquidation phase.
However, the notified resolution does not exhaust all the effects of the insolvency: the announcement itself warns that the effects of the opening of the liquidation “will be resolved in a separate resolution,” meaning that the concrete scope regarding the assets and management capacity of the company will be established in a subsequent judicial decision. The publication in the BORME serves the purpose of providing public registry notice of the company’s new insolvency status to third parties.
Four years of corporate life
The company’s registry history allows for the reconstruction of its path to this situation:
- Incorporation: the company was incorporated and began operations on July 19, 2022, according to the announcement published in BORME number 144, dated July 29, 2022.
- Initial corporate purpose: main activity CNAE 6209, other services related to information technology and computer science, with a share capital of 29,801.66 euros.
- Original address: calle Tramontana 12, bajo, in Benirredrà (Valencia).
- Sole proprietorship: sole shareholder and sole administrator José Manuel Malonda Figueres.
- Change of address: relocation to calle Sinia 31, escalera 1, 1, in Gandia, published in BORME number 132, dated July 13, 2023.
- New corporate purpose: expansion into computer programming (CNAE 6201), consulting, IT resource management, and other services, published in BORME number 204, dated October 25, 2023.
A specific procedural channel for small businesses
The special procedure for micro-enterprises is the route that insolvency law reserves for smaller companies, featuring simplified formalities and shortened deadlines compared to ordinary insolvency proceedings. In this case, the opening occurs nearly two years after the initial declaration of insolvency, in November 2024, reflecting the liquidation phase that the Valencian company is now entering.
The relevance of the news is twofold. For the creditors of Omsuntech Sociedad Limitada, the official publication establishes the moment from which the insolvency is opposable and places the procedure within the jurisdiction of the Commercial Court No. 2 of Valencia, before which the claims must be asserted. For commercial traffic, the announcement adds a new entry to the registration record—the fifth in its history—certifying the insolvency of a technology company established in 2022 in the Safor region and later relocated to Gandia.
