Melilla revokes the temporary assumption of Social Policies

The President of the Autonomous City of Melilla has signed Decree No. 339, dated August 20, 2026, which revokes the temporary assumption of the competencies of the Department of Social Policies and Public Health and confirms the effective incorporation of its head. The provision, registered under number 2026000339 of the Book of Non-Collegiate Resolutions, is published in the Official Gazette of Melilla number 6408, dated August 25, 2026, on page 4507 (official reference BOME-A-2026-965).
A change in the Government organizational chart
The decree nullifies Decree No. 243, dated May 26, 2026, published in the ordinary BOME number 6383 of May 29, 2026, by which the competencies of the head of the Department of Social Policies and Public Health had been assumed, due to absence, by the head of the Vice-Department of Equality and Women.
On August 20, 2026, the effective incorporation of the head of the Department occurred, which prompts the revocation of the provisional measure. The decision is framed within the institutional structure created by the Presidential Decree No. 0914, dated July 10, 2023, which established the new organization of the City’s Departments, and in the decree on the distribution of competencies among the Departments of the Autonomous City of Melilla.
Legal basis and procedures
The provision is issued by virtue of the competencies attributed to the President by the legal system, in particular:
- Organic Law 2/1995, of March 13, which approves the Statute of Autonomy of Melilla.
- Law 40/2015, of October 1, on the Legal Regime of the Public Sector.
- The Government and Administration Regulations of the Autonomous City of Melilla.
The decree further provides to report to the Plenary of the City Assembly and proceed with its publication in the Official Gazette and its dissemination on the Transparency Portal, in accordance with Law 19/2013, of December 9, on Transparency, Access to Information and Good Governance.
Appeals against the resolution
As this is a final act in the administrative process, interested parties may challenge the decree through two channels:
- Appeal for reversal (recurso de reposición) before the President of the Autonomous City of Melilla, within a period of one month from its notification or publication.
- Contentious-administrative appeal before the Contentious-Administrative Courts, within a period of two months.
If the appeal for reversal is chosen and one month passes without an express resolution, it shall be understood as dismissed by administrative silence.
