Melilla acelera el proceso selectivo de cinco plazas de Ingeniero Técnico Industrial

The Autonomous City of Melilla has declared the urgent processing of the selective procedure for the provision of five Industrial Technical Engineer positions. The decision is formalized in Order No. 4346, of September 24, 2026, from the Ministry of Presidency, Public Administration and Equality, published in the Official Gazette of the Autonomous City of Melilla (BOME) No. 6418, of September 29, 2026, with the official reference BOME-A-2026-1078.

An expanded call from one to five positions

The file, with reference number 48037/2025, was initiated at the request of the General Directorate of Public Service to fill five positions classified under Subgroup A2 through an open competitive examination system. The origin of the process was smaller: on February 18, 2026, the Administration called for a selective process for a single position, belonging to the 2023 Public Employment Offer and not yet executed.

Through an Agreement of the Governing Council of May 15, 2026, that call was modified to incorporate new positions from the 2026 OEP, totaling the current five. The call was published in BOME No. 6356 and the procedure is already in the examination phase.

The authority to resolve corresponds to the Minister of Presidency, Public Administration and Equality by virtue of the Agreement of the Governing Council of July 28, 2023, on the distribution of competencies between ministries (Extraordinary BOME No. 54, of July 31, 2023), in point 7.2.7, section h).

The non-extendable deadline threatening one of the positions

The file invokes Judgment No. 930/2025, of July 9, 2025, issued by the Contentious-Administrative Chamber of the Supreme Court, which reiterates the doctrine regarding the maximum three-year period to execute public employment offers. The ruling establishes that this period, provided for in Article 70.1 of the Recast Text of the Basic Statute of Public Employees (TREBEP), approved by Royal Legislative Decree 5/2015, of October 30, is non-extendable and is only met if the selective process is carried out entirely within it.

According to the order, this deadline would expire in December 2026 for one of the positions. If the process is not completed before then, the automatic expiration of the call and the definitive loss of the offered position would occur.

Reduction of deadlines by half

The urgency is supported by Article 33 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations (LPACAP), which allows it to be agreed upon when reasons of public interest advise it. The effect is the reduction by half of the deadlines of the ordinary procedure, with two exceptions:

  • Deadlines relating to the submission of applications.
  • Deadlines for filing appeals.

The Administration justifies the measure based on the principle of efficiency under Article 103 of the Spanish Constitution and Article 3 of Law 40/2015 on the Legal Regime of the Public Sector, and maintains that the loss of a qualified technical position would cause serious and irreparable harm to structural needs and the budgetary balance of human resources.

The order, signed by the Technical Secretary of Public Administration, Francisco José Rubio Soler, specifies that no appeal may be filed against the agreement for urgent processing, without prejudice to those that may be filed upon completion of the procedure in accordance with Law 39/2015.

Impact for candidates and technical staff

The decision directly affects the applicants competing for these five positions, who will see the deadlines for the successive phases compressed, and the municipal technical staff, awaiting the reinforcement of a structural area. With the urgent processing, the City seeks to ensure that the process concludes before December 2026 and to prevent one of the announced positions from disappearing due to expiration.
