Melón delegates to the first deputy mayor during the mayor's vacation

The Melón City Council has delegated all mayoral functions to the first deputy mayor during the mayor’s vacation period, spanning from August 30 to September 30, 2026. The measure was approved by Mayoral Resolution no. 278, dated August 18, 2026, and published in the Official Gazette of the Province of Ourense on September 3, 2026, in the local entities section.

The delegation, transcribed literally in the gazette, enables the deputy mayor to exercise the direction and management of the municipality and to resolve administrative procedures affecting third parties during the mayor’s absence.

Legal framework of the substitution

The resolution invokes Art. 23.3 of Law 7/1985, of April 2, regulating the bases of the local regime, as well as Arts. 44 to 47 and Art. 115 of Royal Decree 2568/1986, of November 28, which approves the Regulation on the organization, operation, and legal regime of local entities. According to these regulations, deputy mayors substitute for the mayor in all their functions in cases of absence, illness, or impediment.

The delegated body must subsequently inform the Mayor’s Office of the management carried out and the provisions issued during the period, and in any case when previously requested.

Conditions of the delegation

The delegation is conferred upon Marco Antonio Portela da Conçeiçao, first deputy mayor, and includes:

• The powers of direction and management of the council.
• The authority to resolve appropriate administrative procedures through the adoption of administrative acts affecting third parties.
• The obligation to inform the Mayor’s Office of the management carried out and the provisions issued during the period.

For its effectiveness, the delegation requires the acceptance of the delegated body, although it will be understood as tacitly granted if no express acceptance is formulated within three business days from the notification of the resolution. The resolution must be published in the Official Gazette of the Province and reported to the Plenary in the first subsequent session.

Appeals and validity

Against the resolution, which ends the administrative route, a motion for reconsideration may be filed, as a prior and optional measure, before the Mayor’s Office of the Council within one month, or a contentious-administrative appeal before the Contentious-Administrative Court of Ourense within two months, both counted from the day following the receipt of the notification.

The delegation will be in effect throughout the mayor’s period of absence, from August 30 to September 30, 2026, thus guaranteeing the continuity of municipal administrative management for a full month.

The publication of this delegation ensures the legal certainty of the residents and the people who process procedures with the council during the mayor’s vacation, as the acts adopted by the deputy mayor will have full validity and administrative effectiveness.
