Rural Affairs imposes a second coercive fine in a forestry case in Lugo
Por FactBox Admin

The Territorial Department of Lugo of the Ministry of Rural Affairs has notified the imposition of the second coercive fine in the sanctioning file MON-LU-0095/2024-FOR. The act, issued on September 29, 2026, and signed by the territorial director Mª Olga Iglesias Fontal, is published in the Official Gazette of Galicia (DOG) no. 198 of Monday, October 19, 2026, on page 53058. The publication by announcement is due to the fact that personal notification to the interested party was attempted but could not be carried out.
The text is inserted in section VI (Announcements), heading A) Autonomous administration, and bears the official reference CVE-DOG: s9lz2p43-ktl9-dev8-19w7-zigvjnzntdj9. The processing is based on articles 44 and 46 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, which enable the substitution of personal notification by an announcement in the official bulletin when the former was not possible. The announcement itself specifies that it is also published in the DOG, “although the effectiveness of the notified act will be subject to its publication in the BOE”.
File MON-LU-0095/2024-FOR corresponds to the province of Lugo and shares the suffix FOR with three other files notified on the same day by the same territorial department. The ordinal “second” indicates that a previous coercive fine had already been imposed in the same procedure, meaning the obligated party did not execute what was required by the first.
Ten days to appear in Lugo
The notification does not reproduce the full content of the act: to know it, the interested party must go to the administrative offices within a fixed period.
- Deadline: ten days counting from the day following the publication of the announcement.
- Place: Legal-Administrative Service of the Territorial Department of Lugo of the Ministry of Rural Affairs, rolda da Muralla, 70, Lugo.
- Office hours: from 9:00 to 14:00 hours.
- Effect of silence: once the deadline has passed without appearance, the notification is understood to have occurred from the following day.
Seven announcements from the same department in a single day
The DOG of October 19 contains a block of seven announcements from the Territorial Department of Lugo regarding sanctioning execution, four of them already with a coercive fine imposed and three with a prior warning:
- Second coercive fine, file MON-LU-0095/2024-FOR (p. 53058).
- Fifth coercive fine, file MON-LU-0128/2022-FOR (p. 53061).
- Third coercive fine, file MON-LU-0130/2023-FOR (p. 53062).
- Eighth coercive fine, file MON-LU-0144/2022-FOR (p. 53063).
- Prior warning before the imposition of coercive fines, file MON-LU-0048/2025-DIS (p. 53057).
- Prior warning before the imposition of coercive fines, file MON-LU-0112/2025-CAF (p. 53059).
- Prior warning before the imposition of coercive fines, file MON-LU-0115/2025-CAF (p. 53060).
From the second to the eighth fine: the coercive escalation
The comparison between the files published on the same day depicts an escalation: opposite the second fine of MON-LU-0095/2024-FOR, there is a procedure already at the fifth fine (MON-LU-0128/2022-FOR) and another at the eighth (MON-LU-0144/2022-FOR). The coercive fine does not replace the sanction, but is added to it and repeated in periods until the obligated party complies with the order, which explains why a single file can accumulate up to eight successive impositions.
The announcement of file MON-LU-0095/2024-FOR identifies in the annex the NIF of the interested party (33817854B) and the notified act, the imposition of the 2nd coercive fine. Furthermore, a formal discrepancy is published in the block: the announcement of the third fine heads the file as MON-LU-0130/2023-FOR, while its annex records it as MON-LU-130/2023-FOR.
For forest owners in the province of Lugo, the publication of these announcements is the means by which the regional Administration considers acts notified that could not be communicated personally. Anyone who recognizes their NIF or their file must appear at the rolda da Muralla before the ten-day period expires: if they fail to do so, the act is considered notified and the procedure moves forward, with new cumulative coercive fines and without the publication in the DOG exhausting the effects, which depend on the BOE.
