Marinaleda abre 45 días de alegaciones al Plan Básico de Ordenación Municipal

The Marinaleda City Council has submitted for public review the initial approval of its Basic Municipal Planning Plan (PBOM), approved by the Plenary in an ordinary session on September 29, 2026, along with the Strategic Environmental Study (EAE) and the Health Impact Assessment Document (DVIS). The announcement is published in the Official Gazette of the Province of Seville number 209, corresponding to Wednesday, October 28, 2026, with the official reference BOP-SE-2026-209016. The period for filing objections is 45 business days, counting from the day following the publication of the announcement in the Official Gazette of the Junta de Andalucía.

The agreement affects the instrument that establishes the urban planning for the entire municipality and, therefore, the land classification and future building conditions. The processed file is 2026/PES_02/000166 and the drafting of the document corresponds to the technical team Buró 4 Arquitectos, S.L.P..

Unanimous Approval

The Plenary of the Marinaleda City Council adopted the initial approval agreement unanimously by the members present in the ordinary session held on September 29, 2026. The initial approval extends to the PBOM and the two accompanying environmental and health documents, and does not constitute the final approval of the planning.

The announcement appears on page 88 of the provincial gazette, within the Local Administration section, and is signed by the Mayor-President, Sergio Gómez Reyes, with an electronic signature date of October 1, 2026.

Forty-five Days to File Objections

During the public exhibition period, the complete file remains available to any interested party for examination and for the submission of objections, suggestions, or claims. The enabled channels are as follows:

  • In-person consultation at the headquarters of the Marinaleda City Council, at Avenida de Andalucía 119, Monday to Friday from 9:00 to 14:30 hours.
  • Electronic consultation through the municipal Electronic Office, at https://www.marinaleda.es.
  • Submission of objections, suggestions, or claims within the period of 45 business days.

The submission for public review is supported by article 78.3 of Law 7/2021, of December 1, for the promotion of the sustainability of the territory of Andalusia (LISTA); article 104.1 of the General Regulation approved by Decree 550/2022, of November 29; and article 38.4 of Law 7/2007, of July 9, on Integrated Environmental Quality Management.

The PBOM is one of the general urban planning instruments created by the LISTA, along with the Municipal General Planning Plan, and its approval is the responsibility of the municipality. The preparation of these plans is supported by a line of grants from the Territorial Cohesion Area of the Provincial Council of Seville: the current bases and call for applications were approved by Presidency Resolution No. 5613/2026, dated August 11, published in BOP number 179, dated September 15, 2026, intended to finance the hiring of external drafting teams and subject to monitoring by the Provincial Council.

The urban planning process coincides in time with other ongoing municipal files, such as the public exhibition of the 2025 General Account and the credit modification 2026/TCP_01/000003, for 35,000 euros, both published in BOP number 192, dated October 2, 2026.

The allegations period opens the final relevant window for residents, landowners, and local groups to influence the municipal model before final approval. What is decided now will condition, for years to come, the developable land, the permitted uses, and the environmental and health requirements of any development in Marinaleda.
