Manzanal de Arriba delegates the inspection of Bar El Lobo Feroz

The City Council of Manzanal de Arriba has published a delegation decree in the Official Gazette of the Province of Zamora (No. 97, August 21, 2026), whereby the mayor, Nazario Castedo Bobillo, recuses himself from processing the review file for the license of the premises “Bar El Lobo Feroz” and delegates his powers to a councilor. The measure is a response to the fact that the mayor and the municipal secretary are being investigated for a possible crime of administrative malfeasance in proceeding 377/2025.

The decree, signed on August 17, 2026, with reference R-202602033, is issued under Article 44 of Royal Decree 2568/1986, which regulates the Regulations on Organization, Operation, and Legal Regime of Local Entities. The affected file is number 66/2026, relating to the review of the activity and opening license and the restoration of urban legality of the establishment located at Calle Real, number 3.

The conflict of interest

The municipal secretary, José Luis González Delgado, informed the mayor that he could not intervene in the processing as he is being investigated along with the mayor in proceeding 377/2025, pursued before the Court of First Instance, Civil and Instruction Section, Court No. 1 of Puebla de Sanabria, at the request of Julio Fernández Peláez. The mayor’s duty to recuse himself is based on Article 23 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, due to having a pending litigious matter with an interested party.

The delegation and its waiver

Initially, the Mayor’s Office delegated the powers to councilor Antonio Lorenzo Clemente, who on August 4, 2026, waived the exercise of the delegated functions for personal reasons. In response to that waiver, the decree accepts the resignation and delegates the processing to councilor Nicanor Peláez Peláez, who must always resolve in accordance with the technical and legal reports issued by the officials of the Provincial Council of Zamora.

Background of the file

The premises, dedicated to the activity of Oven-Roaster and Bar, hold an activity license granted on October 10, 2000, and an opening license from January 2, 2001, both in favor of Julio Fernández Peláez. An urban and environmental inspection, requested by the Mayor’s Office on February 7, 2025, detected discrepancies with what was granted, including the clear height of the ground floor, the opening of the exterior door, and the lack of signaling beacons on the stairs.

The resolution emphasizes that the proceedings must be carried out in strict observance of the principles of objectivity, impartiality, legal certainty, and the right to a hearing for the interested party. The case demonstrates how a conflict of interest with judicial relevance compels the corporation to reorganize its competencies to guarantee the neutrality of the procedure, in a matter that directly affects the economic activity of an establishment within the municipality.
