Mancha Real approves the regulations for its La Inmaculada elderly residence

The City Council of Mancha Real (Jaén) has definitively approved the Internal Regulations of the Assisted Residence for the Elderly of Mancha Real, known as “La Inmaculada,” a municipally-owned center that offers accommodation, coexistence, and comprehensive care for elderly people. The decision, adopted by Mayor María del Mar Dávila Jiménez, is published in the Official Gazette of the Province of Jaén, number 161, dated August 20, 2026, under reference 2026/3970, and will enter into force the day following its publication.

The text was initially approved by the municipal Plenary on June 24, 2026 and, in accordance with Article 49 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, it was submitted for public consultation for 30 business days. The edict was disseminated in the BOP of Jaén number 123, dated June 29, 2026, and on the City Council’s electronic notice board, with no claims filed during the period.

Rights and duties of the users

The regulations include a wide catalog of residents’ rights, most notably privacy and data protection, physical and moral integrity, non-discrimination, individualized care, and equal treatment. The right to healthcare and pharmaceutical assistance, to maintain interpersonal relationships and receive visits, and to voluntarily cease the use of services is also guaranteed.

• Right to dignified treatment and not to be discriminated against on the basis of age, sex, religion, or opinion.
• Right to information, participation, and individualized care.
• Right to submit suggestions and complaints through the Suggestions and Complaints Book.
• Duties of coexistence, mutual respect, proper use of the facilities, and participation in the financing of the service.

Admissions, discharges, and operating regime

Access to places requires that continuous healthcare in a hospitalization regime is not needed and the expression of the will to access the place. Incorporation must take place within a maximum period of 15 business days, and users enjoy an adaptation period of four months. Discharge occurs due to death, voluntary resignation, non-payment for more than two months, unjustified absences, or very serious breaches of coexistence.

The center remains open 365 days a year and sets schedules for meals, outings, and visits. Balanced nutrition is guaranteed with breakfast, lunch, afternoon snack, and dinner, and smoking is prohibited except in designated areas. The co-payment of monthly fees shall be made within the first five days of the month, preferably by bank direct debit.

Participation and disciplinary regime

A Center Council will be established as the ordinary channel for participation, composed of the management, three users, a secretary, a workers’ representative, and a representative from the Mancha Real City Council. Its members are elected by secret ballot and serve a two-year term, meeting in ordinary session once per quarter.

The regulations classify offenses as minor, serious, and very serious, with statutes of limitations of two, four, and six months, respectively. The imposition of sanctions corresponds to the Provincial Delegations of the competent Department and the General Directorate for Older Persons, depending on the severity.

The final approval of these regulations provides legal certainty to the management of “La Inmaculada” residence and directly affects the residents and their families in Mancha Real, who now have a clear framework regarding rights, obligations, admissions, discharges, and coexistence within the center.
