Lugo cancels the official reader position of the 2021 OEP due to expiration

The mayor and president of the Lugo City Council, María Elena Candia López, has resolved to void the selection process for permanent access to two positions of reading official in the open category, exclusively in relation to the position corresponding to the public employment offer (OEP) of the year 2021. The decision, adopted by resolution on August 11, 2026, is published in the Official Gazette of the Province of Lugo number 191, Saturday, August 22, 2026, under reference R. 2252.

The measure is caused by the declaration of expiration of the public employment offers of the Lugo City Council for the years 2017, 2018, 2020, 2021, and 2022 that were not executed within the three-year period, agreed upon by the Local Government Board through Agreement 1/502, adopted in the session of December 17, 2025.

A Supreme Court ruling sets the criterion

The expiration is based on judgment 930/2025, of July 9, 2025, from the Contentious-Administrative Chamber of the Supreme Court, which upheld a cassation appeal and established that the three-year period provided for in article 70.1 of the TRLEBEP (Legislative Royal Decree 5/2015) must be understood as fulfilled when the selection process is carried out entirely within that period, and not merely with the publication of the call.

As a consequence of this jurisprudence, the process convened by Decree 2488/2024, of March 19, 2024, published in the BOP of Lugo number 86 on April 13, 2024, was affected because it was executing a position from the 2021 OEP that had not been executed within the legal period.

What is preserved and what is annulled

The resolution distinguishes between the two positions that made up the call:

• OEP 2021 Position: the selection process is voided, as it is affected by the declaration of expiration.
• OEP 2023 Position: all administrative acts issued are preserved and the procedure continues, as it is not affected by the expiration.

The file already had approved lists of admitted and excluded candidates, through Decree 9985/2024 (provisional list, October 25, 2024) and Decree 9519/2025 (definitive list, October 13, 2025).

Appeals and procedure

The agreement, qualified as a procedural act, will be published on the municipal notice board and in the BOP of Lugo. The following appeals may be filed against it:

• Optional appeal for reversal before the Mayor’s Office, within one month.
• Contentious-administrative appeal before the Contentious-Administrative Court of Lugo, under the terms of articles 8, 25, and 46 of Law 29/1998.

The decision, adopted based on the powers of article 124 of Law 7/1985 and Decree 4003/2026, directly affects the applicants already admitted to the process, for whom the position linked to the 2021 OEP is annulled, while the 2023 OEP position maintains its processing.
