Lucena: una concejala renuncia a su dedicación exclusiva tras ser diputada andaluza

The Lucena City Council has accepted the resignation of councilwoman María de las Nieves Ortiz López de Ahumada from the exclusive dedication regime of her position, effective July 23, 2026. The decision was formalized by Mayoral decree on September 21, 2026, and published in the Official Gazette of the Province of Córdoba number 190, dated October 1, 2026 (reference BOP-A-2026-3208). The reason for the resignation is the appointment of the councilwoman as a Deputy of the Andalusian Parliament.

According to the text of the decree, the councilwoman communicated via a written document registered on September 3, 2026, her designation as a Deputy of the Andalusian Parliament and her effective appointment on July 24, 2026. She proved her status as an elected deputy with the credential issued on July 24, 2026, which led the City Council to process her deregistration from Social Security effective July 23, 2026.

The request, in which she asked for the right to receive attendance fees for the commissions in which she participates as she is no longer “under a release regime,” is interpreted as an implicit resignation from the exclusive dedication regime. The decree is based on article 13.4 of Royal Decree 2568/1986, of November 28, and article 75.5 of Law 7/1985, of April 2, regulating the Bases of Local Regime.

Background of the position

Ortiz López de Ahumada was appointed Third Deputy Mayor by Mayoral decree on June 19, 2023. The performance of that position under an exclusive dedication regime was agreed upon by the Plenary in the session of June 22, 2023, and the interested party accepted it in that same session.

Content of the decree

The decree of the mayor, Aurelio Fernández García, provides in its operative part:

  • To accept the councilwoman’s resignation from the performance of her position under the exclusive dedication regime, effective July 23, 2026, the last day of her remaining in that status.
  • To notify the resolution to the interested party and communicate it to the Payroll and Social Security Department, the Funds Audit Office, and the Municipal Treasury.
  • To publish the resolution on the City Council’s notice board and in the Official Gazette of the Province, in compliance with article 75.5 of Law 7/1985.
  • To report the resolution to the Plenary of the City Council in the next session to be held.

Effects on the remuneration regime

The resignation implies that the councilwoman ceases to receive the remuneration corresponding to exclusive dedication and begins to be governed by the regime of attendance-based indemnities, as she herself requested for the commissions in which she participates. The remuneration change is retroactive to July 23, 2026, the date on which the City Council had already processed her deregistration from Social Security.

Publication in the official bulletin validates and publicizes the change in the councilwoman’s status, as she will balance her role as a councilor with her seat in the Andalusian Parliament without exclusive municipal dedication. The matter must also be communicated to the Plenary in its next session, where a formal account of the modification in the remuneration composition of the local government team will be provided.
