Logroño summons those interested in the contentious litigation against Bergasa
Por FactBox Admin

The Administrative Litigation Court, court number two of Logroño, has summoned potential interested parties in ordinary proceeding 222/2026, filed against the Bergasa City Council. The announcement, disseminated by the council itself, grants a period of nine days to appear in the judicial process. The resolution is published in the Official Gazette of La Rioja no. 187, dated September 29, 2026, with reference BOR-A-20260929-III–3665.
The summons is issued in compliance with Article 49 of Law 29/1998, of July 13, Regulating Administrative Litigation Jurisdiction, which requires notification to all those who may have a legitimate interest in the matter before forwarding the file to the judicial body. The court has agreed to issue an official request to the Bergasa City Council to remit the administrative file and, simultaneously, has ordered the summoning of interested parties so they may appear.
The procedure is processed through the ordinary channel and its object is described as “other acts of the administration,” without the official announcement detailing the specific municipal act being challenged. The text appears in section III of the gazette, dedicated to other provisions and acts, on page 16431, under file number 202609260124658 and ordinal III.3665.
Who is litigating and who represents them
- Plaintiffs: Flora Lauroba González and Mario Prieto Von Deschau.
- Lawyer: Sonia Fernández Garrido.
- Court Representative (Procurador): Mario Subirán Espinosa.
- Defendant Administration: Bergasa City Council.
- Judicial Body: Administrative Litigation Court, court number two of Logroño.
- Proceeding: ordinary 222/2026.
The summons is the procedure by which the judicial body notifies those who were not party to the administrative process that an open case exists and that they may intervene in it. In this case, the call is addressed to potential interested parties in the file processed by the Bergasa City Council, not to the parties already appearing in the case.
Deadline and effects of appearance
The deadline is nine days starting from the day following the publication of the announcement, that is, from September 30, 2026. Those who do not appear within that term will remain outside the procedure: the gazette warns that the case will proceed without any further notification being served to them.
The summons will be incorporated into the administrative file that must be sent to the judicial body, so the appearance must be formalized before the court itself. The announcement was signed in Bergasa on September 9, 2026, by the mayor-president, Luis Argaiz Eguizabal.
A dispute over municipal acts
The procedure pits two private individuals against the Bergasa City Council before the contentious-administrative jurisdiction, the route reserved for the judicial control of the actions of public administrations. The publication of the summons in the official bulletin is the mechanism provided to ensure that the call reaches all affected parties, including those whose identity is not expressly listed in the file.
For the residents and holders of rights affected by the challenged municipal act, the announcement is the entry point to the process: anyone who does not appear within the fixed period will be excluded from a litigation that may annul or confirm the decision of the Bergasa City Council. The insertion in the Official Gazette of La Rioja no. 187 makes the summons an official notification for all purposes.
