León aprueba el nuevo reglamento de la residencia municipal Virgen del Camino

The León City Council has definitively approved the Internal Regulations of the Virgen del Camino Municipal Residence for the Elderly, the public care center for older adults located at Avenida San Mamés, 8-10. The full text is published in the Official Gazette of the Province of León number 189, dated October 2, 2026, under the official reference BOP-LE-2026-189009, and replaces the regulation in force since 2016.

Approval without objections and entry into force

The Plenary of the León City Council, in an ordinary session on June 26, 2026, agreed upon the initial approval of the regulations and its public exhibition on the Electronic Office Notice Board. The procedure, in accordance with article 49.b) of Law 7/1985, of April 2, regulating the Bases of the Local Regime, opened a 30-business-day period for claims, with the file available to interested parties until September 8. As no claims or objections were submitted, the regulation is understood to be definitively approved.

The regulation repeals the text approved by the Municipal Plenary on April 28, 2016, and published in the Official Gazette of the Province on September 6 (number 170). Its entry into force will occur once the regulation has been published in full and the fifteen days provided for in article 65.2 of Law 7/1985 have elapsed. The new framework adapts to Law 3/2024, of April 12, of Castilla y León, and to the Person-Centered Integrated Care (AICP) model.

Access, scale, and waiting lists

Beneficiaries may be individuals who have reached 65 years of age, are registered in the municipality of León with at least two years of uninterrupted seniority, and possess a dependency assessment resolution. Spouses or accredited domestic partners may also gain access from age 60, via a joint application and with two years of continuous cohabitation.

The scale in the annex scores four variables:

  • Socio-family situation: up to 99 points.
  • Functional capacity: up to 100 points.
  • Housing: up to 45 points.
  • Age: up to 6 points.

Places for non-dependent persons are considered those who obtain between 9 and 24 points in functional capacity, and places for dependent persons are those with 25 points or more. The León City Council will issue a quarterly reserve list for each type of place with at least 10% of the center’s capacity, and the waiting list will be ordered according to the score obtained. The lack of an express resolution within six months will be understood as a rejection.

Admission, prices, and stays

The granting of a place shall be resolved by Mayoral Decree or by the delegated councilor, with incorporation within 10 days and an adaptation period of up to 30 calendar days. Voluntary absences may not exceed 48 calendar days per year and shall entitle the resident to a 50% reduction in the contribution; non-payment without justified cause for three consecutive months is classified as a very serious infringement.

Prices shall be set by the Public Price Regulatory Agreement, which will be published in the Official Provincial Gazette. Payment is mandatory for the resident and, if they cannot afford it, family members shall be responsible in accordance with Article 143 of the Civil Code. Visiting hours are set from 10:00 to 13:00 and from 16:30 to 20:00 hours.

Bodies and disciplinary regime

The center shall have a Management, a Technical Advisory Council, a Center Council, and a Participation Council, the latter consisting of two representatives of the residents elected directly with a two-year mandate, re-electable up to a third consecutive term.

Infringements are classified as minor, serious, and very serious. Sanctions range from verbal or written warnings to the temporary suspension of user status, for more than three and less than six months, and definitive suspension with expulsion from the center. The procedure shall be instructed by the Management of the residence in accordance with Laws 39/2015 and 40/2015.

The regulations fully govern the relationship between the center, the residents, and their families, and directly affect those who already occupy a place, applicants on the waiting list, and new petitioners. The León City Council shall ex officio review the applications already included in the waiting list to adapt their score to the new scale, retaining the previous score if the review results in a lower one.
