Álava regula la diligencia debida de los proveedores de servicios criptoactivos

The Provincial Government Council of Álava approved Provincial Decree 36/2026, of October 13, which approves the development of due diligence rules and reporting obligations for certain crypto-asset service providers. The decision was adopted in the ordinary session held on October 13, 2026, and is published in the Official Gazette of the Historical Territory of Álava (BOTHA) number 121, of October 21, 2026, in section I. The official announcement carries the reference 2026_121_02939.

The decree falls under the Department of Treasury, Finance, and Budgets of the Provincial Council of Álava, according to the order of matters established by the summary of provisions approved by the Provincial Government Council and disseminated by the General Secretariat. This is the only regulatory-level provision included in that session: the remaining approved points are agreements, totaling 24, ranging from 645/2026 to 668/2026.

The text is organized around two blocks, as stated in its official wording: on one hand, the development of due diligence rules; on the other, reporting obligations. The subjective scope covers crypto-asset service providers, although the published summary specifies that the regulation is addressed to “certain” operators, without specifying in that summary which subset of companies is ultimately obligated.

What the gazette publishes and its scope

BOTHA number 121, of October 21, 2026, inserts the summary of the provisions approved in the ordinary session of October 13, within the announcements section of the Provincial Council of Álava under the title “General Assemblies of Álava and Provincial Administration of the Historical Territory of Álava”. The decree appears on the first of the three pages of the announcement, heading the provincial decrees section.

The document was electronically signed by the Provincial Council of Álava on October 21, 2026, at 05:59 hours (UTC), with the entity’s electronic seal and a certificate issued by Izenpe. The gazette retains the legal deposit D.L.: VI-1/1958 and ISSN 2254-8432.

The summary is limited to recording the approval: it does not reproduce the articles, the adaptation deadlines, or the sanctioning regime, meaning that the regulatory details must be consulted in the full text of the provision.

The remaining agreements of the session

Along with the decree, the Provincial Government Council approved in the same session of October 13, among other points:

  • Agreement 645/2026: designation of the representation of the Provincial Council of Álava in various entities.
  • Agreement 651/2026: budgetary modification to fund the “Livestock Aid Plan 2026” item, for the years 2026 and 2027.
  • Agreement 663/2026: payment of direct aid applications provided for in Article 58 of Royal Decree-Law 7/2026, of March 20.
  • Agreement 667/2026: draft provincial regulation for the ratification of the agreement with the General Administration of the Autonomous Community of the Basque Country regarding the joint operation of the EMSIME application.

Impact for companies and users

The regulation places Álava among the administrations that transfer the requirements for identification and provision of information in the crypto-asset sector to the provincial level. The impact falls on companies operating as crypto-asset service providers with activity in the territory and, indirectly, on their clients, who become subject to the due diligence procedures developed by the regulation.

For the fintech sector in Álava, the practical consequence is the incorporation of documentary and reporting obligations that until now lacked specific provincial development. The publication in the BOTHA opens the period for affected operators to become familiar with the text and adjust their internal procedures for client identification and reporting to the provincial Treasury.
