Álava opens the period for allegations regarding the expropriation of the Alegría-Dulantzi sanitation collector

The Provincial Council of Álava has submitted for public review the initial list of assets and rights affected by the “Construction project of the Alegría-Dulantzi sanitation collector, section I: Alegría-Oreitia”, according to the announcement published in the Official Gazette of the Historical Territory of Álava (BOTHA) on Wednesday, August 26, 2026, number 97. The decision was adopted through Agreement 541/2026 of the Provincial Government Council, held on August 4, 2026, which initially approved the aforementioned list.

The announcement, signed on August 13, 2026, by the Director of Road Infrastructure, María Ángeles Gutiérrez Ondarza, is processed under articles 17 and 18 of the current Compulsory Expropriation Law and article 17 of its implementing Regulations. The file corresponds to the Department of Sustainable Mobility and Road Infrastructure of the Provincial Council of Álava.

Deadline and method for submitting allegations

The list of assets and rights will be on display for a period of 15 business days, calculated from the day following the publication of the announcement in the official gazette. During this period, any interested party may provide in writing the appropriate data to rectify possible errors in the published list or oppose, for reasons of substance or form, the need for occupation.

Those who oppose must indicate the reasons why they consider the occupation of other assets or the acquisition of other rights, different from and not included in the list, to be preferable and more convenient for the intended purpose. Allegations shall be submitted within the provided deadline at the General Registry of the Provincial Council of Álava or at any of the locations contemplated in article 16.4 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Affected assets and municipalities

The initial list identifies the estates and rights necessary for the execution of the sanitation collector in its first section, between Alegría-Dulantzi and Oreitia. The affected lands are located in the municipalities of Elburgo, Vitoria-Gasteiz, and Alegría-Dulantzi, and include arable plots, irrigated land, wasteland, and transit and loading areas, as well as publicly and privately owned estates.

Among those affected are numerous private owners and entities, with individualized cadastral references in the annex of the announcement, which spans eleven pages of the bulletin. The work, defined as a sanitation aqueduct, is part of the improvement of the sanitation network of the Llanada Alavesa.
