Las Palmas approves the modification of the Vegueta-Triana Special Plan

The Governing Board of the City of Las Palmas de Gran Canaria has initially approved the Minor Modification of the Special Protection Plan for Vegueta-Triana, in execution of a judicial ruling that alters the protection level of a property in the historic center. The agreement, adopted in an ordinary session on July 30, 2026, is published in the Official Gazette of the Province of Las Palmas number 100, dated August 21, 2026, and opens a one-month period for allegations.

The modification stems from the ruling of November 7, 2024, issued in ordinary procedure number 157/2018 by the Contentious-Administrative Chamber (2nd Section) of the High Court of Justice of the Canary Islands. The ruling modified the protection level assigned to the property located at calle Cano, number 12, corresponding to File VT-053 of the Special Plan’s Protection Catalog, a modification formulated and promoted by the City Council itself.

Suspension of urban planning licenses

The initial approval entails the automatic suspension of the granting of urban planning licenses within the territorial scope of the modification, in accordance with articles 99.1 and 86.2 of the Planning Regulations of the Canary Islands. The effects of this suspension will expire upon the final approval of the instrument or, in any case, after two years have elapsed since the initial approval.

• The suspension area coincides with the physical delimitation of the cataloged plot, located at calle Cano, number 2, Vegueta neighborhood.
• However, licenses may be processed and granted for projects adapted to the regime in force at the time of the request, provided they are not altered by the proposed determinations or if these are less restrictive than the current planning.

Public information process and allegations

The file is submitted for public information for a period of one month, counted from the day following the publication of the announcement in the Official Gazette of the Canary Islands, in accordance with article 147.3 of Law 4/2017, of July 13, on Land and Protected Spaces of the Canary Islands. The announcement will also be inserted in the Official Gazette of the Province, in a newspaper of wider circulation, and on the municipal Edicts Board, with exhibition on the electronic headquarters.

Appeals and consultation with administrations

The modification is likewise subject, for a period of one month, to the consultation process of the public administrations affected territorially or by reason of their competencies. As it is a procedural act, the initial approval does not end the administrative route; therefore, no appeal may be filed against it, except for the exceptional cases set forth in Article 112 of Law 39/2015.

An optional appeal for reversal (recurso de reposición) may be filed against the agreement to suspend licenses within one month before the same body, or it may be challenged directly before the Contentious-Administrative Jurisdiction within two months of its publication. Once the appeal for reversal has been filed, the contentious appeal may not be formulated until the former is resolved or its presumed dismissal occurs, in which case the period shall be six months.

The decision is of particular relevance to the owners and developers in the surroundings of Vegueta, one of the city’s most valuable historical complexes, as it conditions the granting of licenses on the affected plot over the coming months and establishes the new protection regime for the property at 12 Cano Street in compliance with a final judicial ruling.
