Las Gabias declares the expropriation of the Carlos Cano Road urgent

The Las Gabias City Council has declared the urgent occupation of the assets necessary to execute the Carlos Cano Road, within the compulsory expropriation file 2332/2026. The resolution summons the affected owners and rights holders on September 24, 2026, at 9:00 AM, to draw up the records prior to occupation. The agreement is published in the Official Gazette of the Province of Granada number 181, dated September 18, 2026, with the official reference BOP-GRA-2026-181024.
The Governing Board of the Las Gabias City Council, meeting in an ordinary session on August 3, 2026, adopted the agreements now being published regarding the expropriation of the land required for the Carlos Cano Road, as provided for in Innovation number 9 of the PGOU-Adaptation NN.SS. 97 of Las Gabias. The compulsory expropriation file is listed under number 2015 14 25001412 and is managed under reference 2332/2026. The resolution was signed in Las Gabias on August 4, 2026, by the Councilor for Urban Planning, Maintenance, and Sustainable Development, Inmaculada Paloma López García, by Decree 2025/01166, dated May 6.
Reasons for the urgency
The agreement justifies the urgency based on the “serious mobility problems” of the municipality, with excessive traffic that in most cases does not originate from local traffic but from the connection between the different urban centers. Innovation number 9 of the planning includes three major actions over a land area of 31,184.90 m²:
- Structuring road network as a General Communications System in the Gabia center, as a continuation of the Machuchón Road.
- Recreational Equipment as a General Equipment System in the Híjar center.
- Structuring road network as a General Communications System in the Híjar center.
To decongest the urban centers of Híjar and Gabia, two outer roads have been planned, the Carlos Cano Road and the Machuchón Road, which will link with the provincial roads GR-3311 Híjar, GR-3304 Cúllar Vega, and GR-3303 Gabia. The document notes that the Machuchón Road is already under execution and that the works for the Granada Metro are completed and in the review phase, with an expected start of operation by the end of 2026.
Summons for the prior records
Affected parties must appear at the offices of the Urban Planning Area of the Las Gabias City Council on September 24, 2026, at 9:00 AM, according to the list included in the plenary agreement of 04/27/2026. Interested parties must attend personally or be represented by a person with accredited representation and present:
- Proof of identity document (D.N.I./N.I.F.).
- Documentation proving ownership: simple informative note or certificate of ownership and encumbrances from the Property Registry, public deed, receipt of the Property Tax (IBI) from the last year, or certified photocopies.
They may be accompanied, at their own expense, by experts and a notary. In the event of non-appearance, the proceedings shall be understood as conducted with the Public Prosecutor’s Office, in accordance with Article 5 of the Compulsory Expropriation Law (LEF). Until the minutes are drawn up, written allegations may be submitted to the City Council to correct possible errors in the list of assets, according to Article 56.2 of the Compulsory Expropriation Regulations. The notification and edicts must be issued at least eight days in advance, with publication on the official notice boards, in the Official Gazette of the Province of Granada, and in one of the highest circulation newspapers, in addition to the municipal Transparency Portal. The Mayor’s Office is authorized to appoint the expert who, together with the mayor, will act in the drawing up of the minutes.
The affected properties
The annex lists thirteen properties, with a total occupation area of 23,920.71 m²:
- GRUPO INMOB. RODRÍGUEZ TORRES SL: 4,405.71 m² (property 1a) and 909.47 m² (property 1b).
- RODRÍGUEZ TORRES JOSÉ ANTONIO: 4,754.54 m².
- MUÑOZ ROS PEDRO: 287.88 m².
- GONZÁLEZ CASTILLA JUAN JESÚS: 1,761.19 m².
- DÍAZ MUÑOZ JUAN JOSÉ Y HNA: 3,231.63 m².
- HROS. DE LUIS PECETE ARIZA: 1,452.86 m² and 1,666.13 m².
- DÍAZ MUÑOZ ANTONIO MIGUEL Y HNOS: 1,904.76 m².
- VALENZUELA GÓMEZ ANTONIO Y OTROS: 892.29 m².
- RUIZ MORALES FRANCISCO: 1,084.20 m².
- CAPILLA SOLERA JUAN MANUEL: 726.87 m².
- RODRÍGUEZ DONAIRE DAVID Y HNOS.: 843.18 m².
Impact for the residents
The declaration of urgency opens the expository route and shortens the deadlines: the owners of the thirteen properties in the annex have until September 24 to appear or submit allegations, and the effective occupation of the land is enabled once the prior minutes have been drawn up.
