Laracha will tender technical assistance for the CMAT of the Costa da Morte geodestination

The City Council of Laracha will process the tender for the technical assistance service for the Board of Directors of the Costa da Morte Tourism Association (CMAT) through a management entrustment. The collaboration agreement that makes this possible was signed on July 30, 2026, by the mayor, José Manuel López Varela, and the vice president of the association, Margarita Lamela Louzán, and was published in the Official Gazette of the Province of A Coruña (BOP) number 178, dated September 17, 2026, in the Local Administration section, under announcement number 2026/5995.
The agreement arises from the association’s lack of resources
The purpose of the agreement is to arrange collaboration between the CMAT and the Laracha City Council to entrust the latter with the tender for the contracting of the association’s technical assistance service, which must provide technical secretariat and technical and legal support to its Board of Directors. The CMAT justifies this formula because it lacks the personnel and technical infrastructure to prepare and tender the contract, while the Laracha City Council, the association’s headquarters, has a greater technical and legal structure and a contracting board accustomed to this type of procedure.
The service is considered fundamental for the internal functioning of the association of councils, for its representation before public and private entities, and for its action as the managing body of the Costa da Morte Geodestination. It also includes assistance in processing applications, coordination and supervision of activities, and justification within the framework of the subsidy and financing lines for which the CMAT may be eligible.
Background and legal framework
The Board of Directors of the CMAT agreed on June 15, 2026, to request the Laracha City Council to process the management entrustment. The Local Government Board of the council accepted the proposal on June 22, 2026, and approved the entrustment in accordance with Article 11 of Law 40/2015, of October 1, expressly authorizing the mayor-president to formalize the agreement.
The text bases its competence on the following regulations:
- Articles 25.1 and 57.1 of Law 7/1985, of April 2, regulating the Bases of the Local Regime.
- Article 11 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, regarding management entrustments.
- Articles 47 onwards and 143 onwards of Law 40/2015, regarding collaboration agreements and inter-administrative collaboration formulas.
- Law 9/2017, of November 8, on Public Sector Contracts.
Distribution of obligations and control
The Concello da Laracha assumes full management of the procurement file: the justifying report, the particular administrative clauses and technical specifications, necessary reports and assistance to the contracting board, and the drafting of the proposed resolutions. It is also responsible for the administrative acts that are not the exclusive competence of the commissioning body and for execution incidents, such as contract modifications, price revisions, or the imposition of penalties.
The CMAT, as the commissioning body, will issue the supporting legal resolutions—initiation, approval, award, and formalization of the contract—will fully finance the contract, and will assume direction and execution, appointing a responsible officer. It may also appoint representatives to attend as members of the contracting board sessions.
The commission entails no financial obligations or commitments between the parties, justified by the public interest of the joint action. The maximum validity of the agreement is four years and it expires upon the completion of the contract subject to the commission. Monitoring is the responsibility of a Commission composed of the mayor and the secretary of the Concello da Laracha and the vice president and the treasurer of the CMAT.
The publication in the BOP gives the green light to a tender that will open the provision of a structural service for Xeodestino Costa da Morte to companies in the region, in a context where the tourism association cannot handle the processing of the file on its own.
