La Selva and Osor formalize the commission to tender the management services

The Consell Comarcal de la Selva and the Osor City Council have formalized a management entrustment agreement for technical assistance to draft the tender documentation for the management services contract processed by the municipality. The agreement, approved by the Council’s Permanent Commission in the session of July 7, 2026, and formalized on August 12, 2026, is published in the Official Gazette of the Province of Girona (no. 161, of August 21, 2026), with official reference BOP-2026_0_161_7379 and file 2026/00009452N.
The agreement is based on the comarcal competence for technical, legal, and economic assistance to municipalities provided for in articles 25 and 28 of Legislative Decree 4/2003, which approves the Recast Text of the Law on comarcal organization of Catalonia. The Osor City Council entrusts this assistance because it does not possess sufficient personal, material, and technical means to draft the documentation for the procurement procedure, for which it is competent according to the second additional provision of Law 9/2017, on Public Sector Contracts.
Signatories and object of the entrustment
The document is signed by the president of the Consell Comarcal de la Selva, Martí Pujals Castelló, and the mayor of Osor, Joan Pla Coll, acting authorized by their respective plenums. The object is the establishment of the collaboration framework for the management entrustment of technical assistance in drafting the documentation for the management services contract.
The entrustment does not constitute a contract subject to Law 9/2017, given that both administrations do not have a market vocation, act in the public interest, and without profit motive. The administrative and legal responsibility for the procedure rests exclusively with the City Council, while the documents prepared by the Council are considered technical proposals.
Documentation to be drafted
The Consell Comarcal commits to preparing the necessary documentation for the tender of the management services contract:
- Proposal for the Mayoral provision or initiation order.
- Proposal for the technical or necessity report.
- Proposal for the Particular Technical Specifications.
- Proposal for the Particular Administrative Clauses (PCAP, QR, and annexes).
- Proposal for the legal report.
- Proposal for the Plenary agreement approving the procurement file.
- Proposal for the tender notice.
Documents involving the exercise of administrative powers must be signed by the Mayor, and the specifications and secretariat reports by the City Council secretary. The management and processing of the files, as well as the publications in the Contractor Profile, which are assumed by the municipality, are not included in the scope of the agreement.
Cost, validity, and monitoring
The economic valuation of the assistance is applied according to the Council’s tax ordinance T-04, with a cost of 750 euros (senior technician A1, at 75 euros/hour, for 10 hours). The City Council must deposit this amount within a maximum period of thirty days from the approval of the invoice.
The agreement shall remain in force until the delivery of the documentation and, at most, for one year from its formalization, with the possibility of extension for up to four additional years. A monitoring, surveillance, and control commission will be created, composed of one representative from each entity, which may meet electronically.
The publication is made for the purposes of Article 11 of Law 40/2015, on the legal regime of the public sector, and the agreement will also be disseminated on the Council’s e-Board, in the DOGC, and in the Agreement Registry of the Generalitat, in application of Law 19/2014 on transparency. The agreement reinforces inter-administrative collaboration and transparency in public procurement, and allows a small municipality such as Osor to tender its management services with the technical support of the county.
