La Sénia aprova definitivament l'ordenança general que regula totes les subvencions municipals

The La Sénia City Council has definitively approved the General Grants Ordinance, the regulation that establishes the requirements, procedures, and sanctioning regime applicable to all aid granted by the council. The agreement is published in the Official Gazette of the Province of Tarragona on October 5, 2026, with the reference CVE 2026-09087, and the full text occupies pages 1 to 21 of the gazette. The regulation will enter into force the day after the publication of the definitive approval and its full text in the BOPT.

The Plenary of the La Sénia City Council initially approved the ordinance in an ordinary session on July 20, 2026. The agreement was submitted for public consultation for 30 business days through publication in the BOP of Tarragona (CVE 2026-07075, August 3, 2026), the Official Gazette of the Generalitat de Catalunya (CVE-DOGC-A-26204076-2026, July 30, 2026), the Setmanari l’Ebre (July 31, 2026), the municipal electronic office, and the transparency portal. Once the deadline closed, no claims or suggestions were submitted, so the text was definitively approved. The announcement is signed by the mayor, Maria Victoria Almuni Balada, dated September 30, 2026.

The ordinance establishes the general legal regime for grants awarded by the La Sénia City Council and implements Law 38/2003, of November 17, General Grants Law, its implementing regulation (Royal Decree 887/2006, of July 21) and Law 4/2023, on public finances of Catalonia. The stated objective is to guarantee transparency, competition, and efficiency in the management of public funds, under the principles of publicity, objectivity, equality, non-discrimination, and effectiveness.

The text expressly excludes from its scope, among others:

  • Grants to the concessionaire of a public service as consideration for its operation.
  • The transfer of use of real estate to public entities or institutions.
  • Aid to address peremptory needs of a social nature.
  • Contributions to autonomous bodies, consortiums, associations of municipalities, foundations, and associations where the City Council is present in the governing bodies.
  • Fees to associations under the fifth additional provision of Law 7/1985 and grants to municipal political groups.
  • Prizes awarded without prior application and collaboration agreements.

Granting, deadlines, and applications

Grants may be awarded through competitive bidding —the ordinary procedure—, through non-competitive bidding, or directly; the latter is reserved for nominative grants in the budget, those imposed by a regulation of legal rank, and exceptional cases of public, social, economic, or humanitarian interest. The key deadlines established by the regulation are:

  • Six months to resolve the granting procedure, with dismissal by administrative silence if not notified.
  • Ten days to notify the resolution and ten days for the beneficiary to accept the grant.
  • Ten business days to correct defects or provide the required documentation.
  • Three months, maximum, to justify the activity when the regulatory instrument does not set another deadline.
  • Fifteen non-extendable business days to submit the justification after the request from the managing center.

For grants of less than 3,000 euros, the accreditation of being up to date with tax and Social Security obligations is replaced by a responsible declaration.

Reimbursement, sanctions and financial control

The ordinance regulates the loss of the right to payment and the total or partial reimbursement of the amounts received, with late payment interest calculated on the legal interest rate increased by 25%. The reimbursement procedure has a maximum term of twelve months and the City Council’s right to recognize or settle it expires after four years.

Regarding sanctions, infractions are classified as minor, serious, or very serious according to the cases of the General Law on Grants, and fines may be fixed or proportional to the amount unduly obtained, without prejudice to the obligation to return the funds. Financial control is the responsibility of the General Intervention, which may request the collaboration of private auditing firms according to Royal Decree 424/2017, of April 28. An additional provision provides for the creation, by resolution of the Mayor, of a technical advisory body to ensure the application and interpretation of the regulation.

An administrative appeal may be filed against the agreement before the contentious-administrative Chamber of the High Court of Justice of Catalonia, based in Barcelona, within a period of two months from the day after publication.

The new ordinance provides stable regulatory coverage for all aid calls in La Sénia and gathers for the first time in a single text the requirements to be met by entities and individuals, the justification deadlines, and the consequences of non-compliance. This directly affects associations, sports clubs, cultural entities, and companies applying for municipal grants, which will have to adapt applications and justification accounts to the new procedure.
