La Portella seeks an urgent comptroller secretary to fill a vacant position

The La Portella City Council has opened an urgent and non-deferrable procedure to fill the position of secretary-intervention, which will soon become vacant. The council will resolve this through provisional appointment, service commission, or accumulation, according to the announcement of the call and bases published in the Official Gazette of the Province of Lleida (BOP) no. 209, of November 2, 2026, with the official reference BOP-2026_0_209_9102 (edict 9102, pages 1 to 4). The call bears the signature of the mayor, Miquel Carles Català Visa.

The legal framework of an emergency coverage

The decision is based on article 81.3 of the revised text of the Law of the Basic Statute of the Public Employee, approved by Royal Legislative Decree 5/2015, of October 30, and is deployed under the terms of Royal Decree 128/2018, of March 16, which regulates the legal regime of local Administration officials with national qualification (FHN). The council argues that the vacancy is imminent and that the procedure must be initiated urgently, without waiting for the ordinary provision calendars.

The order of preference among the three formulas is not free: provisional appointment takes priority over the other forms of non-definitive provision. The service commission can only be applied if the impossibility of filling the position with a provisional appointment is proven in the file, and accumulation requires that the two previous routes have failed.

Position characteristics and requirements

The position reserved for nationally qualified officials has the following characteristics:

• Designation: secretary-intervention.
• Access subgroup: A1.
• Destination supplement level: 24.
• Annual specific supplement: 18,660.60 euros.

Applicants must be career civil servants of the local Administration scale with national qualification and must prove knowledge of Catalan. Those who hold a sufficiency level certificate (C1) or higher from the General Directorate of Linguistic Policy, or an equivalent degree as set by Order VCP/491/2009, of November 12, modified by Order VCP/233/2010, of April 12, are exempt from the linguistic test.

Those who do not prove C1 must pass an eliminatory test consisting of two parts: a written exercise on practical language knowledge and an oral expression conversation. The tribunal will consist of three career officials, advised by technical personnel from the Consortium for Linguistic Normalization, which will administer the test; the evaluation is subject to Decree 152/2001 and candidates will be graded as fit or unfit.

The functions of the position are those provided for in the regulations of the secretary-intervention scale configured by Royal Decree 128/2018 and, if applicable, those established by the entity’s job position list.

Durations, deadlines and processing

Each form of provision has a defined horizon:

• Provisional appointment: extends until the position is definitively occupied by FHN personnel.
• Service commission: one year maximum, extendable for one more year at the request of the city council if the need persists.
• Accumulation: ends when the position is filled by another non-definitive form of provision or definitively.

The deadline for submitting applications is five business days from the day after the publication of the announcement on the corporation’s electronic notice board and in the BOP of Lleida. Submission is electronic, in accordance with article 16.4 of Law 39/2015, of October 1. The service certificate issued by the General Directorate of Public Function of the competent ministry must be attached or, alternatively, the certificates of services rendered and the supporting documentation of degrees and courses alleged.

Once the deadline has closed, a civil servant with national authorization from the corporation —or, if there are none, a career civil servant and, as a last resort, an interim one— will issue a suitability report for each applicant with a reasoned proposal. This proposal will be submitted to the Presidency and forwarded to the General Directorate of Local Administration of the Generalitat de Catalunya or to the competent State body as appropriate. The announcement will also be communicated to the Council of Colleges of Secretaries, Auditors and Treasurers of Local Administration of Catalonia (CSITAL), via the address informacio@csital.org, so that it can be publicized on the website during the same five-day period.

Against the resolution, which exhausts the administrative route, a request for reversal may be filed within one month before the body that approved the bases, or a contentious-administrative appeal within two months before the Contentious-Administrative Court of Lleida. Impact for the municipality

The filling of the position is not a minor formality: the secretary-intervention assumes public faith, legal advice, and the economic-financial control of the council, so the vacancy affects the ordinary functioning of the city council and its capacity to close files, approve accounts, and execute expenditure with guarantees. The fact that it is a position of national authorization limits candidates to a small group, often already committed to other destinations, which explains the urgency and why the call admits three linked forms of provision.
