La Junta nombra funcionarios de carrera en ejecución de una sentencia judicial

The General Secretariat for Public Administration has arranged for the appointment of career civil servants in execution of the judgment issued by the Contentious-Administrative Chamber of the High Court of Justice of Andalusia based in Granada. The resolution, dated October 6, 2026, is published in the Official Gazette of the Government of Andalusia (BOJA) no. 197, of October 9, 2026, within section 2.1 regarding appointments, statuses, and incidents. The resolution falls under the Ministry of Artificial Intelligence, Digital Development, and Public Administration, the department responsible for the execution of judicial resolutions regarding general public service matters. The objective is to comply with the ruling of the judicial body by appointing the affected individuals as career civil servants, specifying the assigned posts and the nature of their occupancy, as required by Andalusian public service regulations.

BOJA no. 197 includes this provision along with other personnel resolutions from the same day, including several university appointments and competitions from the Andalusian Health Service, confirming the ordinary nature of this type of publication within the authorities and personnel section.

The competency framework of the General Secretariat

The competence to issue these resolutions corresponds to the head of the General Secretariat for Public Administration. Decree 203/2026, of July 30, which establishes the organic structure of the Ministry of Artificial Intelligence, Digital Development, and Public Administration (Extraordinary BOJA no. 15, of July 31, 2026), empowers this body to issue the necessary resolutions in accordance with procedural regulations and to arrange for the compliance and publication of judicial resolutions in proceedings where the Ministry is a party regarding general public service matters.

Added to this is the delegation of powers from the Order of October 6, 2023, which attributes to the General Secretariat, in general matters of public service, the appointment of career civil servants. Decree 51/2025, of February 24, which regulates the planning and organization of Andalusian public employment, establishes in its article 30 that appointments must be published in the BOJA and that the resolutions shall set the start date for the period to take office.

Immediate precedent in the same bulletin

This type of resolution has already been published in the BOJA on recent dates. The closest is the Resolution of August 11, 2026, from the General Secretariat for Public Administration, published in BOJA no. 158, of August 17, 2026 (text no. 11102), which executed a judgment from the Contentious-Administrative Chamber of the High Court of Justice of Andalusia based in Seville.

In that case, the resolution appointed as a career civil servant of the Administrative Assistants body of the Junta de Andalucía (C2.1000) the candidate favored by the ruling, with a score of 93.800 points and order number 39, and set a period of one month to take office, with administrative and economic effects from March 1, 2024. The resolution was signed by the Secretary General, Arturo Enrique Domínguez Fernández.

For candidates and Andalusian public employees, the publication of this resolution represents the culmination of a judicial procedure: the BOJA acts as the official instrument for the execution of the judgment and opens the period for the appointed persons to take possession of their posts. The resolution of October 6, 2026, confirms that the Andalusian Administration is complying with the rulings of the High Court of Justice of Andalusia regarding public service.
