The Regional Government expropriates estates for the Martos-Fuensanta power line

The Territorial Delegation of Economy, Finance, European Funds and of Industry, Energy and Mines in Jaén has called for the drawing up of minutes prior to the occupation of the assets and rights affected by the project for the installation of a new 25 kV double-circuit medium-voltage overhead line and a new 25 kV double-circuit medium-voltage underground line between the Martos substation and Fuensanta de Martos. The announcement is published in the Official Gazette of the Province of Jaén, number 168, dated August 31, 2026, pages 13158 to 13166, under file number AT 4/2018.
The public utility of the project was declared by resolution of the Territorial Delegation itself on May 5, 2026, published in the BOE number 129, dated May 27, 2026, in favor of the beneficiary company E-Distribución Redes Digitales SL Unipersonal, with NIF B82846817 and address at calle Ribera del Loira number 60, Madrid. The declaration is based on article 56 of Law 24/2013, of December 26, on the Electricity Sector, and article 149 of Royal Decree 1955/2000, of December 1, and implies the urgent occupation of the land for the purposes of article 52 of the Compulsory Expropriation Law of December 16, 1954.
Schedule and locations of the summons
The drawing up of the prior minutes will take place over four days, in the facilities provided by the city councils of the districts where the properties are located:
- September 21 and 22, 2026, in the plenary hall of the City Council of Fuensanta de Martos, plaza de la Constitución, 13.
- September 23 and 24, 2026, in the San Juan de Dios cultural room of the City Council of Martos, calle de la Fuente, 7.
The order and schedule for each appearance are listed in the annex of the announcement, which lists the affected properties, their owners, the flight surface and temporary occupation area, and the number of line supports. If the act cannot be held due to force majeure, it will be moved to the first following business day at the same time.
Obligations of the owners
Interested parties must attend personally or be represented by a duly authorized person, accompanied, if applicable, by the tenant, and provide documentation proving their ownership:
- Title deed or simple registry note, together with the latest receipt of the Property Tax (IBI).
- In the case of a lease, the corresponding contract.
- In the event of death, the will or declaration of heirs, acceptance of inheritance, and forms 650 and 660 for the settlement of Inheritance and Gift Taxes.
Those who consider themselves to have a better right may appear on the designated day to file their claim. Failure to appear will not prevent the drawing up of the records, and the fair price, if not received, will be deposited in the General Deposit Fund of the Ministry of Economy, Finance, European Funds and Social Dialogue.
Publicity and Procedure
The announcement will be communicated to each interested party via an individual summons and will be published in the BOE, in the Official Gazette of the Province of Jaén, and in the newspapers IDEAL and DIARIO JAÉN, as well as on the notice boards of the town halls of Martos and Fuensanta de Martos. These publications also serve as notification to unknown interested parties or those with an unknown address, in accordance with Article 44 of Law 39/2015, of October 1, on the Common Administrative Procedure.
The announcement, electronically signed in Jaén on July 6, 2026, by the territorial delegate Javier Calvente Gallego, affects dozens of owners in both municipalities, including numerous heirs and communities of assets, whose plots will be encumbered by an overhead easement and temporary occupation for the construction of the new electrical infrastructure.
The implementation of this medium-voltage line, which will connect the Martos substation with Fuensanta de Martos, reinforces the electrical supply of the region and justifies the expropriation of the land due to its public utility. For those affected, the process now opens a period for allegations and the subsequent determination of the fair price; therefore, it is advisable that they attend the summons with the required documentation to avoid losing rights during the proceedings.
