The Regional Government of Extremadura (Junta de Extremadura) has released for public review the list of assets, rights, and owners affected by the temporary occupation of land intended for archaeological and geotechnical studies of section 4 of the Badajoz Southern Ring Road. The announcement, dated October 1, 2026, is signed by the Secretary General of the Ministry of Infrastructure, Transport, and Housing, Laura Castell Vivas, and is published in the Official Gazette of the Province of Badajoz No. 199, dated October 16, 2026 (announcement 3870/2026). The measure affects 13 estates within the municipality of Badajoz, with a total of 141,196 square meters of temporary occupation.
An infrastructure with more than a decade of procedures
The General Directorate of Road Infrastructure of the Ministry of Infrastructure, Transport, and Housing is drafting the construction project for the “Badajoz Southern Ring Road. Section 4: Exhibition Grounds – A-5 Connection,” an action contemplated in the municipal urban planning. Its informative study was submitted for public review on March 12, 2012 (DOE No. 49), the environmental impact statement was published in DOE No. 233 on December 3, 2012, and the study was definitively approved by resolution on October 6, 2014.
During the drafting phase, the unavoidable need to access certain lands to carry out intensive archaeological micro-surveys, geophysical surveys, archaeological verification boreholes, and geotechnical studies has become evident. According to the announcement, these actions are imposed by the concurrent technical, archaeological, and geotechnical constraints and are essential to define the technical solutions of the project and comply with the determinations of the competent sectoral bodies.
Temporary occupation supported by the Roads Law
Article 12.3 of Law 37/2015, of September 29, on Roads, establishes that the approval of informative studies implies, for the sole purpose of the temporary occupation of land for data collection and the performance of surveys, the declaration of public utility and the urgent need for occupation. The occupation is processed in accordance with Article 108 of the current Compulsory Expropriation Law, for the time strictly necessary for the works, and any damages that may occur will be subject to valuation and compensation.

The announcement and its list will be published in the DOE, in the BOP of Badajoz, in the regional press, and on the notice board of the Badajoz City Council, in addition to being individually notified to the affected holders. Along with the notification, a standardized authorization form for temporary occupation will be sent, the signed return of which will be considered express consent for the execution of the works.
The resolution is the responsibility of the Regional Minister of Infrastructure, Transport and Housing by delegation granted through the Resolution of June 16, 2026 (DOE No. 117, of June 19). The personal data of the interested parties will be incorporated into an automated file owned by the Regional Ministry, for the purpose of managing the expropriation files, and may be transferred to the Regional Ministry of Finance, Public Administration and Social Dialogue.
The publication opens the formal procedure that may lead to the effective occupation of land in the southern area of Badajoz; therefore, the owners included in the list have a limited period to review their data, correct errors, and submit allegations or their consent. The schedule for archaeological and geotechnical works is thus linked to the resolution of this procedure and the progress of a key infrastructure project for the connection of the Exhibition Grounds (Recinto Ferial) with the A-5.
