The Junta executes the ruling that recognizes a position for a civil servant

The Regional Ministry of Finance, Public Administrations and Digital Transformation of the Regional Government of Castilla-La Mancha has executed, on its own terms, the final judgment recognizing the civil servant Ana Beatriz García Rubio’s award of a position in the transfer competition CPL 4-2022, with all derived economic, administrative, and Social Security rights. The resolution, signed on August 27, 2026, is published in the Official Gazette of Castilla-La Mancha (DOCM) number 172, dated September 8, 2026, with official reference 2026/6412.
The ruling stems from Ordinary Procedure 167/2023, resolved by Judgment No. 148/2024, dated April 18, 2024, issued by Court No. 3 of the Social Section of the Court of First Instance of Albacete, and confirmed by Judgment No. 540/2026, dated March 20, 2026, of the Social Chamber of the High Court of Justice of Castilla-La Mancha. The judgment upheld the lawsuit filed by the civil servant against the Regional Ministry and declared her right to be assigned the position requested in the ninth ordinal of her application.
Background of the competition and procedure
The job position with code 2776 was published on December 21, 2022, within the framework of the Permanent Transfer Competition CPL 4-2022, and was awarded by competition on June 22, 2023. On July 21, 2026, an Order was issued in the Execution of Judicial Titles procedure ETJ 111/2026, ordering execution against the regional Administration for compliance with the final judgment, and by Decree of the Justice Administration Lawyer, the Regional Ministry was required to proceed with its execution within one month.
The resolution orders the administrative regularization of position 2776 and the recognition of the economic and administrative effects corresponding to the period between the publication of the competition and the award of the position.
Recognized effects and period to be regularized
The resolution recognizes all economic, administrative, and Social Security rights derived from the award of the position that judicially belonged to the civil servant, under the terms established in the final judicial resolutions. The period subject to regularization is delimited as follows:
- From December 21, 2022, the publication date of CPL 4-2022.
- Until June 22, 2023, the date of the award by competition of position 2776.
Furthermore, regarding the period between December 23, 2022, the date of taking office, and June 21, 2023, the date prior to obtaining the position through a competitive process, the appropriate administrative effects are recognized, including the computation of services, seniority, professional career, and any other right linked to the performance of the position, as well as the corresponding economic effects following the appropriate settlements.
Compliance and appeals
The resolution orders the competent bodies in matters of personnel and payroll to carry out whatever actions are necessary for the full effectiveness of the resolution and the correct execution of the judgment, and provides for the communication of the same to the competent judicial body to certify compliance with what was ordered in procedure ETJ 111/2026. The document is signed by the Director General of the Civil Service, José Narváez Vila, by delegation of the Minister of Finance, Public Administrations, and Digital Transformation.
Against the resolution, the corresponding incident of execution of judgment may be filed before the corresponding Jurisdiction, pursuant to Article 109 of Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction.
The execution of this final judgment reinforces the guarantee of the rights of public employees of the regional Administration and underscores the obligation of the Junta to effectively comply with judicial resolutions, with retroactive effects that include the payment of remuneration and the computation of services since 2022.
