The Regional Government delegates the contracting of the CEIP Berrugete dining hall

The Department of Education of the Junta de Castilla y León has delegated to the Provincial Directorate of Education of Valladolid the contracting of the construction works for a new dining hall at the CEIP Alonso Berrugete in Valladolid, with a budget exceeding 600,000 euros. This measure is detailed in Order EDU/874/2026, dated September 4, published in the Official Gazette of Castilla y León number 176, dated September 10, 2026, on pages 78 and 79.

The delegation responds to the need to address the requirements and the quality of schooling at the educational center, and seeks to streamline processing and achieve greater effectiveness and efficiency in the execution of the works.

Regulatory Framework

The order is based on Order EDU/378/2017, dated May 19, which already provided for the delegation of contracting competencies for works in non-university public teaching centers and administrative buildings to the provincial directorates of education, although limited to budgets not exceeding 600,000 euros. Since the dining hall project exceeds that threshold, the Department has opted for a specific delegation.

The legal basis is completed by Article 48 of Law 3/2001, dated July 3, of the Government and Administration of the Community of Castilla y León, and by Article 9 of Law 40/2015, dated October 1, on the Legal Regime of the Public Sector.

Scope of the Delegation

The delegation grants the Provincial Directorate of Valladolid the powers that legislation attributes to the Minister of Education as the contracting authority, including those for expenditure approval, regarding the construction contracts for the new dining hall. Competencies regarding other complementary contracts necessary for the execution of the works are also delegated.

The order establishes, however, limits to the delegation:

• It shall not include those competencies whose exercise requires submission to the agreement or deliberation of the Junta de Castilla y León, pursuant to Article 48.3.f) of Law 3/2001.
• In all acts issued under the delegation, this circumstance must be expressly indicated, mentioning the date of the order and its publication in the gazette.
• Such acts shall be considered issued by the delegating body.

Effectiveness and Signature

The order, signed by the Minister of Education, María Pardo Álvarez, in Valladolid on September 4, 2026, shall take effect from its publication in the Official Gazette of Castilla y León. The official reference of the document is BOCYL-D-10092026-176-8.

The decision assigns the project management to the province where the work will be carried out, which is expected to shorten the bidding and awarding deadlines. For the educational community of CEIP Alonso Berrugete, this delegation represents a step forward toward the construction of a dining hall that improves schooling conditions and the center’s dining service.
