The Regional Government declares the Padul power line to be of public utility

The Regional Government of Andalusia (Junta de Andalucía) has specifically declared as being of public utility the renovation of the Fargue–Valcaire 132 kV high-voltage overhead line and the new T1 support tower in the municipality of Padul. The resolution, signed by the territorial delegate Gumersindo Fernández Casas on September 2, 2026, is published in the Official Gazette of the Province of Granada number 183, dated September 22, 2026, with reference BOP-GRA-2026-183001. The declaration entails the compulsory expropriation of the necessary land and the urgent occupation of five estates.
The Territorial Delegation of Economy, Finance, European Funds and University, Industry, Energy and Innovation in Granada is processing file E-7977, promoted by E-Distribución Redes Digitales, S.L.U. (NIF B82846817), which requested the declaration on November 27, 2024. The project is titled “Renovation of the DC Fargue–Valcaire Órgiva-Valcaire 132 kV OHVL and new T1 support tower for the connection of the P.F.V. Virgen de las Angustias evacuation OHVL, in the municipality of Padul (Granada)” and already held prior administrative and construction authorization, granted by resolution on October 28, 2024.
The file was submitted for public consultation in accordance with Royal Decree 1955/2000, of December 1, with announcements in the Official State Gazette (BOE) and the Official Gazette of the Regional Government of Andalusia on July 11, 2025, in the Official Gazette of the Province of Granada on July 7, 2025, and in the newspaper Granada Hoy on July 15, 2025. It was also displayed on the notice board of the Padul City Council and on the Transparency Portal of the Regional Government of Andalusia.
Dismissed Allegations
During the public consultation process, a written submission was received from Sistema Eléctrico de Conexión Valcaire, S.L., owner of an affected estate, alleging that the promoter had neither communicated nor attempted to negotiate the execution of the project and requesting that the declaration of public utility be dismissed.
The Administration rejected the allegation, considering that negotiations regarding the fair price can occur “at any time,” according to Article 24 of the Compulsory Expropriation Law, and that Article 151 of Royal Decree 1955/2000 allows the applicant to freely agree with the owners on acquisition by mutual consent. The resolution emphasizes that the eventual lack of an amicable agreement does not, by itself, prevent the procedure from continuing.
The Five Affected Estates
The annex to the resolution details the affected assets and rights, all located in the municipality of Padul, polygon 17:
- Sistema Eléctrico de Conexión Valcaire, S.L.: plot 721, Cantarranas area, almond trees and wind facilities; T1 support of 24.60 m², span of 76.65 m and temporary occupation of 558.16 m².
- Planta Fotovoltaica Patria I SLU: plot 720, Cantarranas area, arable land and wind facilities; temporary occupation of 436.77 m².
- Herederos de Trinidad Garrido Rodríguez: plot 722, Cantarranas area, pastures; affection of 164.09 m and 573.87 m².
- Ayuntamiento de Padul: plot 512, Valcaire area, scrubland and wind facilities; affection of 54.07 m and 253.73 m².
- Herederos de Ramón Pérez Parejo: plot 709, Cantarranas area, rain-fed olive groves; affection of 110.42 m and 492.77 m².
Conditions and means of appeal
The declaration is made for the purposes of the compulsory expropriation of full ownership of the land or the establishment of the corresponding easements of way, and implies the need for occupation and urgent occupation in accordance with Article 52 of the Compulsory Expropriation Law and Article 149 of Royal Decree 1955/2000. E-Distribución Redes Digitales, S.L.U. acquires the status of beneficiary of the expropriation proceedings.
Against the resolution, which ends the administrative route, a contentious-administrative appeal may be filed before the High Court of Justice of Andalusia and, optionally, a request for reversal before the Territorial Delegation within one month from the day following its notification or publication.
The decision unlocks the execution of an electrical evacuation infrastructure in the municipality of Padul and enables the promoting company to urgently occupy private and municipal land, with the subsequent opening of the fair price proceedings for the five affected owners.
