The Regional Government declares the Baza-Benamaurel power line to be of public utility

The Territorial Delegation of Economy, Finance, European Funds and University, Industry, Energy and Innovation in Granada has specifically declared as being of public utility the closing of the medium voltage line (LMT) connecting the Jabalcón and Baza substations. The resolution, signed on September 5, 2026, is published in the Official Gazette of the Province of Granada no. 185, dated September 24, 2026, under reference BOP-GRA-2026-185001, and implies the urgent occupation of the affected lands.

File E-5316 originates from the request submitted on March 29, 2026, by E-Distribución Redes Digitales, S.L.U. (CIF B82846817), with a notification address at calle Escudo del Carmen, 31, Granada. The prior administrative and construction authorization was granted on April 14, 2026, and the declaration is based on article 56.1 of Law 24/2013, of December 26, on the Electricity Sector, and Royal Decree 1955/2000, of December 1.

A 20 kV line between Jabalcón and Baza

The project is titled “Closing of LMT line ‘Campo_Cama’ 20 kv ‘Jabalcón’ substation with line ‘Castril’ 20 kv ‘Baza’ substation between support no. 1 and support no. 28, Parajes la Granja, Cortijo Grande, Hoyas de Luna, Cortijo Nuevo and Llano Pozos,” within the municipal terms of Baza and Benamaurel.

Prior to the resolution, the Delegation sent project excerpts to the affected entities and general interest service companies:

• Baza City Council
• Benamaurel City Council
• Guadalquivir Hydrographic Confederation
• Jabalcón Canal Irrigation Community
• Territorial Delegation in Granada of the Ministry of Sustainability and Environment

The public information process was announced in the Official State Gazette no. 116, dated May 13, 2026; the Official Gazette of the Junta de Andalucía no. 88, dated May 11, 2026; and the Official Gazette of the Province of Granada no. 87, dated May 8, 2026, as well as in the newspaper Granada Hoy (May 28, 2026) and on the notice boards of both city councils. There is no record of any objections being filed.

33 affected properties in Baza and Benamaurel

The annex to the resolution lists 33 properties with their cadastral data and their flight, support, and temporary occupation easements. Among the owners are:

• Guadalquivir Hydrographic Confederation (plots 1, 2, 3, 4, 6, 19, 21 and 23)
• Baza City Council (plots 5, 13, 16 and 20)
• Ramón Montes Cabrera (plot 24)
• Natural persons identified by DNI, including 52529057R, 74603210L, 24054276W, 23637094V, 24043115L, 45718393M, 45717079W, 52519535R, 74618727B, 74610151Z, 52514810Z, 52514267T, 52513504L, 52525356A and 74610126N

The affected areas are La Granja, Cortijo Grande, Hoyas de Luna, Cortijo Nuevo, and Llano Pozos, featuring pasture crops, timber pine forests, rainfed and irrigated farmland, olive groves, almond trees, and esparto grass fields. The greatest flight impact corresponds to plot 2, in the Canal del Jabalcón, with a length of 966.33 meters and a surface area of 7,641.99 square meters.

Deadlines and appeals

The declaration is made for the purposes of the compulsory expropriation of full ownership of the land and the establishment of rights-of-way, and E-Distribución Redes Digitales, S.L.U. acquires the status of beneficiary of the expropriation proceedings. The company may freely agree with the owners on acquisition by mutual consent.

Against the resolution, which concludes the administrative process, the following may be filed:

• An optional appeal for reversal (recurso potestativo de reposición) before the Territorial Delegation, within one month from the day following its notification or publication.
• A contentious-administrative appeal before the High Court of Justice of Andalusia.

The resolution is signed by the territorial delegate, Gumersindo Fernández Casas.

The declaration of public utility accelerates the occupation of the land and shifts the negotiation of compensation to the owners and irrigators of Baza and Benamaurel, with the judicial route as a last resort.
