The Regional Government creates the Conde de Gazola nursery school at the León base

The Regional Government of Castilla y León has approved the creation of the «Conde de Gazola» preschool, owned by the Ministry of Defense, at the military base located in Ferral del Bernesga, in the municipality of San Andrés del Rabanedo (León). The agreement, adopted upon the proposal of the Regional Minister of Education, is published in the Official Gazette of Castilla y León no. 183, dated September 21, 2026, under reference BOCYL-D-21092026-183-28.

Agreement 141/2026, of September 17, of the Regional Government of Castilla y León, responds to the request made by the Ministry of Defense under Article 17 of Organic Law 8/1985, of July 3, regulating the Right to Education, which grants the Governing Council of the autonomous community the authority to create and suppress public centers. The decision was adopted following deliberation by the Governing Council at its meeting on September 17, 2026.

The invoked legal framework includes Article 15 of Organic Law 2/2006, of May 3, on Education, which urges administrations to progressively increase the offer of public places in the first cycle of early childhood education and to coordinate their policies through agreements. The Regional Government verified that the center meets the requirements of Decree 12/2008, of February 14, and an inter-administrative agreement was previously signed between the Ministry of Defense and the General Administration of the Community of Castilla y León.

Characteristics of the new center

The agreement details the conditions of the created preschool:

• Name: «Conde de Gazola» Preschool.
• Owner: Ministry of Defense.
• Center code: 24023059.
• Address: Carretera del Campamento, s/n («Conde de Gazola» Base).
• Location: Ferral del Bernesga; municipality of San Andrés del Rabanedo; province of León.
• Authorized teachings: first cycle of Early Childhood Education.
• Units and school places: 3 units and 41 school places, with one unit for each age group.

Registry enrollment and capacity limits

The school will be registered ex officio in the Registry of Teaching Centers of the Community of Castilla y León with code 24023059, according to the second section of the agreement. The third section establishes that the maximum capacity of the units may at no time exceed the number of school places resulting from the minimum surface area ratios per place and the maximum number of children per unit provided for in Articles 8 and 9 of Decree 12/2008, of February 14.

The agreement between the Ministry of Defense and the General Administration of the Community of Castilla y León is registered in the registry of agreements under number 2026/1/26, signed on August 13, 2026, and valid until August 14, 2030, according to the list published in the Official Gazette of Castilla y León no. 181, of September 17, 2026.

Appeals and deadlines

Against the agreement, which exhausts administrative remedies, the following may be filed:

• An optional appeal for reversal (recurso potestativo de reposición) before the Regional Government of Castilla y León, within a period of one month.
• A contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León, within a period of two months.

Both periods are calculated from the day following the publication of the agreement in the gazette. The text appears signed by the President of the Regional Government of Castilla y León, Alfonso Fernández Mañueco, and by the Minister of Education, María Pardo Álvarez, in Valladolid, on September 17, 2026.

The creation of this preschool expands the public offering of the first cycle in the district of León and provides educational coverage for families linked to the military base, in application of the mandate for the progressive increase of public places that state regulations direct to educational administrations.
