The Junta authorizes the Montellano solar plant in Morón and enables expropriations
Por FactBox Admin

The Territorial Delegation in Seville of Economy, Finance, European Funds and of University, Industry, Energy and Innovation has granted San Isidro Solar 6, S.L. the modification of the prior administrative and construction authorization for the HSF Montellano photovoltaic plant, 5.6 MW, in Morón de la Frontera. The same resolution specifically declares the public utility of the associated electrical evacuation infrastructure, which enables the expropriation of the necessary land. The agreement is published in the BOP of the province of Seville No. 208, Tuesday, October 27, 2026 (reference BOP-SE-2026-208047), within the Autonomous Administration section.
Background and processing of the file
The plant obtained its initial authorization on October 29, 2024, granted by the then Territorial Delegation of Economy, Finance and European Funds and of Industry, Energy and Mines, and published in the BOP of Seville No. 25, February 6, 2025. On May 13, 2025, the company requested the modification of the prior and construction authorization and, in the same act, the specific declaration of public utility for the evacuation infrastructure, providing the mandatory list of affected assets and rights. This list was updated by the petitioner on March 9, 2026, with no subsequent modifications.
The file, processed under number 291.122 and registration R.E.G. 5.755, was submitted for public information in accordance with Title VII of Royal Decree 1955/2000, with announcements inserted in the BOJA No. 109 (June 9, 2026), the BOP of Seville No. 108 (June 8, 2026), the BOE No. 161 (July 3, 2026) and the newspaper ABC (July 10, 2026), in addition to the notice board of the City Council of Morón de la Frontera, displayed between May 12 and June 22, 2026. No allegations were presented during the public exhibition period.
Conformity of the bodies and connection point
The resolution confirms the conformity between the petitioner and the affected administrations and companies, who were given thirty days to review the request, the technical documents, and the summary of the environmental impact study:
- City Council of Morón de la Frontera
- E-Distribución Redes Digitales, S.L.U.
- Territorial Delegation in Seville of the Ministry of Tourism, Sport and Culture
- Provincial Council of Seville
- Guadalquivir Hydrographic Confederation
The access and connection were resolved with the report issued on April 12, 2023 by E-Distribución Redes Digitales, which granted a maximum evacuation power of 4.839 MW at the bars of the SET Torrejón 15 kV, accepted by the applicant. The document was signed by Iván Pestaña Ruiz on October 14, 2026.
A plant with 9,120 modules and 1,830 meters of line
The technical characteristics detailed in the resolution are as follows:

- Peak power of the modules: 5.928 MWp; installed power: 5.6 MW.
- 9,120 photovoltaic modules of 650 Wpeak on north-south axis trackers (−55º/+55º).
- Nineteen inverters of 300 kW and two transformation centers of 2,800 kVA (0.8/15 kV).
- Maximum evacuation power: 4.839 MW, limited by a Power Plant Controller.
- Evacuation line of 15 kV and 1,830 meters: 120 meters underground, 1,640 meters overhead, and 70 meters underground up to the SET Torrejón position.
- Technical project with visa EGR2300778, dated May 8, 2025, from the COIIAOR; project author: industrial engineer Juan Navarro Navarro, member no. 1163.
- Petitioner’s address: calle Santa Lucía 1K, 18194, Churriana de la Vega (Granada); CIF B-42.924.969.
Effects on property and means of appeal
The declaration of public utility implies the need for the occupation of assets and urgent occupation for the purposes of Article 52 of the Forced Expropriation Law of 1954, with the company acquiring the status of beneficiary of the expropriation proceedings. Before the drawing up of preliminary reports, the company must provide a list specifying the strictly indispensable assets; agreements with owners that allow for the use of the land will make the exercise of expropriation powers unnecessary.
An optional appeal for reversal may be filed against the public utility part within one month, and an administrative appeal may be filed against the administrative authorization before the Counselor of University, Industry, Energy, and Innovation within the same period. Execution and commissioning must comply with the deadlines of Royal Decree-law 23/2020, and the installation may not operate without the commissioning report.
The resolution concludes a procedure of nearly a year and a half and makes Morón de la Frontera one of the Sevillian municipalities with new authorized photovoltaic power, while opening the door to the occupation of private land for the evacuation line: a step that directly affects the owners of the plots crossed by the 1,830 meters of wiring.
