The Junta awards a retroactive posting to a kitchen assistant in Jimena.

The General Directorate of Human Resources and Civil Service of the Department of Artificial Intelligence, Digital Development and Public Administration has resolved to award Francisca Amo Leiva, with DNI no. *6169, a definitive posting to job position 21668710 “Kitchen Assistant” at the CEIP Nuestra Sra. de los Remedios in Jimena (Jaén). The decision, adopted by resolution of 11 August 2026, is published in Official Gazette of the Andalusian Regional Government (BOJA) number 158, of 17 August 2026, and implements the resolution of 2 June 2026 that partially upheld the interested party’s administrative appeal.

The procedure begins with the Resolution of 21 December 2022, which called, through the competitive selection system, for access to the status of permanent labor personnel in groups III, IV and V, linked to the ordinary Public Employment Offers of 2020 and 2021 and the stabilization offers of 2021 and 2022 (extraordinary BOJA no. 35, of 30 December). The Selection Committee approved the definitive lists of applicants on 5 May 2025, in which Ms. Amo Leiva did not appear, and she filed an administrative appeal on 4 June 2025.

A partially upheld appeal

The resolution of 2 June 2026 recognized the appellant, in the section on experience in positions equivalent to the category to which she aspires, a total of 3,873 days, equivalent to 38.730 points in that section. With that score, the applicant moved to position 15 on the definitive list of selected persons, which led to the offer of vacancies and the subsequent award in accordance with her score and stated preference.

The awarded posting

The resolution awards job position 21668710 “Kitchen Assistant”, under the Territorial Delegation of the Department of Education in Jaén, and orders the modification of the staffing structure of the General Administration of the Andalusian Regional Government in the terms set out in the annex. According to the annex, the position carries an associated specific supplement of €2,632.44 and is listed as a position to be phased out.

Retroactive effects and deadlines

The award shall have economic and administrative effects from 1 September 2025, in accordance with the resolution of 10 July 2025 approving the final list of placements in the selection process, while incorporation into the post shall take place on 1 October 2026. An action may be brought against the resolution before the Social Division of the corresponding Court of First Instance, in accordance with Articles 1, 2 and 6 of Law 36/2011, of 10 October, regulating the Social Jurisdiction, within two months of its publication. The resolution is based on Article 122 of Law 5/2023, of 7 June, on the Public Service of Andalusia, and on Article 115 of Decree 51/2025, of 24 February, and was signed by the Director General, Antonio Parralo Vegazo.

The publication thus corrects a score initially not recognised and reorders the list of selected candidates, with retroactive economic effects recognising the worker’s rights from September 2025. For the remaining applicants in stabilisation processes, the resolution confirms the administrative appeal as an effective mechanism for reviewing the assessment of merits in the competitive selection procedures for access to Andalusian public employment.
