La Generalitat deniega la fotovoltaica FV Andilla en suelo no urbanizable

The Third Vice-Presidency and Department of Environment, Infrastructure, Territory and Recovery has denied the authorization for implementation on non-developable land, the prior administrative authorization, and the administrative construction authorization for the photovoltaic project FV Andilla. The resolution is published as an announcement in the Official Gazette of the Province of Valencia number 188, dated September 30, 2026, with reference 2026/11763 and file number ATALFE/2022/3/46.

A file initiated in 2022

The announcement is signed by the Territorial Service of Industry, Energy and Mines of Valencia, the unit that processes authorizations for electrical installations in the province, and is inserted in section I of the gazette, within the announcements of the Consell of the Generalitat Valenciana. The file code, ATALFE/2022/3/46, places the origin of the processing in 2022 and frames it within the series of authorization files for electrical installations in the province of Valencia.

The published text does not detail the technical, environmental, or territorial reasons for the denial, nor the characteristics of the plant (power, surface area, or promoter): the gazette limits itself to publicizing the operative part of the resolution.

The Official Gazette of the Province of Valencia, edited by the Provincial Council of Valencia, publishes announcements sent by the bodies of the Generalitat and by the local entities of the province, and warns that the publications are the sole responsibility of the sending bodies.

What is being denied

The denial resolution covers three distinct administrative pronouncements, all of which are necessary to execute the plant:

  • Authorization for implementation on non-developable land.
  • Prior administrative authorization.
  • Administrative construction authorization.

Since all three were rejected jointly, the FV Andilla project lacks the enabling title for its implementation or its construction at the planned location.

What it implies

A denial resolution ends the administrative procedure in the sense requested: the Administration rejects the requested authorizations and the developer cannot execute the installation under this file. The announcement is published to publicize the decision and open the path for any appeals that may be applicable against the resolution.

The denial of FV Andilla directly affects the project developer, who sees the administrative route for this plant closed for now, and the owners of the affected lands, who are left without the expectation of occupation linked to the installation. For the surrounding municipalities, the decision keeps the non-urbanizable land without the planned industrial implementation, in a context where the same territorial service continues to publish authorization resolutions for photovoltaic plants in the province of Valencia.
