Por FactBox Admin

The Generalitat has delegated to the Santa Pola City Council the competencies to fully execute the new Santa Pola-Gran Alicante Auxiliary Clinic, with a maximum financing limit of 5,105,641.46 euros. The decision is formalized through the Resolution of October 15, 2026, signed by the Minister of Health, Marciano Gómez Gómez, and published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10475, of October 21, 2026, in section III of administrative acts (CVE: DOGV-C-2026-32522).

The framework for the operation is Decree Law 12/2025, of July 22, of the Consell, which regulates cooperation between the Generalitat and the city councils of the Valencian Community to build and expand public primary care health centers. Article 6.1 establishes that the delegation is formalized by a resolution from the head of the Ministry of Health and must be published in the DOGV.

The Santa Pola City Council submitted the application on September 5, 2025, accompanied by the certification of the plenary agreement and a technical report with the description of the action and the maximum estimated amount. The file incorporates the report from the Director General of Economic Management, Procurement and Infrastructure (September 16, 2026), the necessity report from the Director General of Primary Care (September 14, 2025), the economic report (September 17, 2026), and the resolution proposal from the Director General of Primary Care (September 18, 2026).

A clinic of 1,635 square meters

The new center will have an approximate area of 1,635.48 m², according to data calculated by the Infrastructure Service of the Ministry of Health. The resolution sets the assigned population at 12,314 patients, although section 5.2 of the same resolution figures that population at 9,464 patients, both figures attributed to the Directorate General of Primary Care.

The delegation covers the drafting or updating of the construction project, the technical management, the bidding and awarding of the works contract, the management and execution of the work, the formal reception, and the final settlement. The City Council may draft the project using its own resources or outsource it through public tender.

Funding distributed until 2030

The amount of 5,105,641.46 euros will be paid from chapter VII of subprogram 412B21 of Primary Care, transfer line T0125 “Construction and expansion of primary care centers,” of the managing center G01100204GE0000. The breakdown by annual installments is as follows:

  • 2026: 18,150.00 euros (drafting and project management).
  • 2027: 1,240,129.97 euros (1,046,634.51 for construction and 193,495.46 for drafting and management).
  • 2028: 3,245,446.51 euros (3,139,903.53 for construction and 105,542.98 for drafting and management).
  • 2029: 540,907.75 euros (523,317.26 for construction and 17,590.49 for drafting and management).
  • 2030: 61,007.23 euros, entirely for drafting and project management.

The economic report allocates 1,308,690.00 euros for the current year, while the Sub-Directorate General of Infrastructure estimates the multi-year commitments for line T0125 at 12,117,303.00 euros for 2027, 17,211,452.00 for 2028, 2,416,264.00 for 2029, and 654,345.00 for 2030. Payment will be made upon justification via a certificate from the municipal auditor, with documents submitted before December 1 of each fiscal year, and a certificate of conformity from the General Directorate of Primary Care.

Municipal ownership and maintenance borne by the council

Ownership of the project shall belong to the Santa Pola City Council (CIF P0312100A), which must maintain the healthcare assistance use of the property indefinitely. The Generalitat reserves the intellectual property of the project and may transfer the plot and the construction in its favor once they have been delivered for public use.

Current maintenance expenses—building, furniture, cleaning, security, utilities, and small adaptation works—shall be borne by the city council, in accordance with the second additional provision of Decree-Law 12/2025. Excluded from financing are indemnities for the termination or suspension of contracts attributable to the council, construction modifications, and expenses for the acquisition or adaptation of the plot.

Plenary acceptance and appeal process

The definitive effectiveness of the resolution is subject to the acceptance of the City Council through an agreement of the municipal plenary communicated to the department, pursuant to article 6.5 of Decree-Law 12/2025. The delegation extends over the planned annual installments, and the council must communicate the completion of the project, along with its final settlement, within a maximum period of fifteen calendar days, in addition to preserving the documentation for at least ten years.

Against the resolution, which exhausts administrative remedies, an optional appeal for reversal may be filed within one month, and a contentious-administrative appeal may be filed within two months before the Contentious-Administrative Chamber of the High Court of Justice of the Valencian Community.

The operation transfers to the municipality the responsibility of constructing and maintaining a primary care center in an area with growing demand, with conservation and supply costs charged to local funds, while the Generalitat provides the investment funding. The clinic, of approximately 1,635 square meters, will serve an assigned population that the resolution itself places between 9,464 and 12,314 patients.
