The Minister of Social Rights and Inclusion, Raúl Moreno Montaña, has delegated to the Barcelona Social Services Consortium the competencies to draft the construction projects and execute the construction of four new public residences for the elderly in Barcelona. The decision is formalized in Resolution DSI/3435/2026, of September 25, published in the Official Gazette of the Generalitat de Catalunya (DOGC) no. 9761, of September 30, 2026, within the Other provisions section, with the reference CVE-DOGC-A-26271038-2026. The resolution takes effect the day after its publication, that is, October 1, 2026.
Four facilities and a prior bilateral agreement
The regulation responds to the agreement adopted by the Bilateral Commission between the Barcelona City Council and the Generalitat de Catalunya to build four new residential facilities in the city, with the stated objective of strengthening the public network with new residential places and day centers. The four projects are identified by these names and locations:
- Casernes, in the district of Sant Andreu.
- Eixample.
- Marina del Prat Vermell.
- Glòries.
The delegation covers both the drafting of the construction projects and the execution of the construction works. This includes, among others, the necessary technical assistance, execution management, health and safety coordination, quality control, and other analogous services.
Legal basis and scope of action of the Consortium
The resolution is framed within article 7.2 of the Statutes of the Barcelona Social Services Consortium, approved by Decree 113/2006, of April 25, which provides that the entity may exercise the competencies delegated to it by the consortiumed administrations. It also invokes article 3.8.5 of Decree 133/2024, of August 11, which attributes the planning of care services for the elderly to the Department of Social Rights and Inclusion, and the legal regime regulations: article 8 of Law 26/2010, of August 3, and article 9 of Law 40/2015, of October 1.
The text establishes that the Consortium may exercise the delegated competencies directly, in accordance with public sector contracting legislation, or through any other legal instrument of cooperation or collaboration provided for by current regulations. The acts adopted by delegation shall be considered issued by the delegating body and must incorporate the words “by delegation” before the signature, together with the date of the resolution and the date of its publication in the DOGC.
Multi-year budgetary commitment
The Department of Social Rights and Inclusion assumes the commitment to make the necessary budgetary adaptations to fulfill the delegated competencies. These adaptations will be made in accordance with the multi-year scope planning determined for each residential center project, as set out in the fourth point of the resolution.
With this delegation, the Generalitat transfers to the Barcelona Social Services Consortium the technical and contractual management of four facilities intended to expand the public residential and day center capacity in the city, an operation that affects four districts and is subject to the multi-year budgetary planning of each center.
