Por FactBox Admin

The Provincial Council of Badajoz has opened the public information process regarding the list of assets, rights, and owners affected by the compulsory expropriation necessary to execute the structural conditioning and rehabilitation work of “La Lanzadera” road. The announcement, with reference Announcement 3773/2026, is published in the Official Gazette of the Province of Badajoz number 186, corresponding to Tuesday, September 29, 2026, within the Local Administration section. The list includes 63 estates located in the municipal districts of Medellín, Santa Amalia, Valdetorres, and Guareña, and interested parties have 15 business days to submit allegations.
The file is processed by decree of the Delegated Deputy of the Functional Area of Infrastructure, Mobility, and Territorial Planning, Abel González Ramiro, acting by delegation of the President of the corporation (decree of 06/07/2025, published in the BOP on 06/09/2025). The digital signature of the document is dated September 23, 2026, and it is recorded by the Chief Clerk, María Fernanda Rubio Cortés, Acting Secretary General, by resolution of 09/16/2026.
The technical project for the work was approved on June 26, 2026. The declaration of public utility and social interest, and the subsequent need for the occupation of the assets, are supported by section 1 of article 11 of Law 7/1995, of April 27, on the Roads of Extremadura, which links said declaration to the approval of plans, road programs, and road projects.
Two sections between four municipalities
The operation is divided into two sections: the one from Guareña to Valdetorres via path C-5 and the one running from the end of road CP BA-142, between irrigation ditch XXVI-J, to Santa Amalia. The expropriation is detailed in the corresponding supplement of the project and refers to both full ownership occupation as well as the imposition of easements and damages derived from the execution.
Rice fields, irrigated crops, and an industrial plot
Most of the affected estates are rural, dedicated to irrigated rice fields, irrigated crops, and olive groves. Among the largest areas are:
- Domingo Gallardo Rebolledo, polygon 9, plot 35 of Medellín: 5,340.44 m².
- Ángel Tomás Tena Pérez, polygon 9, plot 34 of Medellín: 3,561.76 m².
- Leonor Andreu Cáceres, Luis Andreu Cáceres and Fernando Andreu Cáceres, polygon 13, plot 4 of Medellín: 3,430.90 m².
- Carlos Gómez Gutiérrez, Purificación Gómez Gutiérrez, Isabel Damiana Gómez Gutiérrez and José Damián Gómez Gutiérrez, polygon 13, plot 2 of Medellín: 3,155.51 m².
- Explotaciones Gordo Morcillo, SL, polygon 13, plot 45 of Medellín: 2,547.63 m².
- Tomates del Guadiana, Sociedad Cooperativa, polygon 13, plot 10 of Medellín: 122.40 m² of urban industrial land.
The file also includes impacts on two-meter-high single-twist metal fences on several plots, including those of Herederos de Julián Nieto Machón (50 meters), Herederos de Julia Durán Muñoz (125 meters) and Ricardo Fernández García (100 meters), as well as a split-block wall and Hercules-type mesh fence on the industrial plot of Tomates del Guadiana, Sociedad Cooperativa.
Allegations, deadlines and publicity
The public information period is 15 business days starting from the day following the publication of the announcement in the BOP. Allegations may be submitted in writing to the Infrastructure, Mobility and Territorial Planning Area of the Provincial Council of Badajoz, at the Citizen Service Office located at calle Felipe Checa, 23, 06071 Badajoz, or by any of the means admitted by the common administrative procedure regulations. The project is available to interested parties at the Infrastructure and Mobility Service of the aforementioned Area.
The announcement and the list of affected parties will also be published in El Periódico Extremadura and on the notice boards of the town halls of the affected municipalities. Furthermore, it will be sent to the Official State Gazette for the purposes of article 44 of Law 39/2015, of October 1, for cases of unknown ownership or unknown address.
Urgent processing
A technical report dated September 22, 2026, certifies the urgency of the execution of the projected work. On this basis, the corporation will request the Regional Government of Extremadura for the declaration of urgent occupation of the affected assets, to be processed in accordance with article 52 of the Compulsory Expropriation Law, in accordance with Royal Decree 2641/1982, of July 24, in its annex I, section B.4.3.
The processing of the personal data of the affected parties is the responsibility of the Provincial Council of Badajoz as the controller, for the purpose of the compulsory expropriation procedure; the Data Protection Officer is J. Enrique Vión Pérez.
The publication opens the decisive moment for the owners of the 63 estates: whoever does not review the list and does not file a claim within the period of 15 business days will see the surface area and ownership listed in the file consolidated, with direct effects on the compensation. The announced request for urgent occupation adds pressure to the calendar, as that procedure allows for the occupation of the assets before the price is definitively set.
