Por FactBox Admin

The president of the Provincial Council of Zamora, Javier Faúndez Domínguez, has delegated to the fourth vice president, Emilio Fernández Martínez, the competencies corresponding to Víctor López de la Parte both as first vice president and in his capacity as delegated deputy for Education, Culture, Tourism, Emigration, and Artistic Heritage. The decision is adopted due to the planned absence of the holder between October 5 and October 16, 2026, both dates inclusive, and is formalized through Decree number 2026-6303, dated October 1, 2026. The announcement is published in the Official Gazette of the Province of Zamora number 116, dated October 5, 2026, in section III, Local Administration, with the official reference R-202602316.
The resolution is issued from the General Secretariat of the provincial institution and is based on the general framework for the delegation of competencies between public administrations. The text invokes Article 103.1 of the Constitution and Article 3 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, which require administrations to serve general interests with objectivity in accordance with the principles of efficacy, efficiency, hierarchy, decentralization, and coordination.
A substitution supported by the Organic Regulation
The delegation by the president to the vice presidents is supported by Articles 30 and following of the Organic Regulation of the Provincial Council of Zamora and by Articles 63 and 64 of the Regulation on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28. These precepts allow for the delegation of the generic exercise of areas or subjects, including the power to issue administrative acts affecting third parties.
The file further recalls that Article 38.2 of the provincial Organic Regulation establishes that vice presidents automatically substitute for the president in cases of vacancy, absence, illness, or other legal impediment, and that Article 67 of the state regulation assigns this substitution by order of appointment. Article 68 adds that the person assuming the functions may not revoke the delegations previously granted by the president.
Delegated competencies and validity
The first resolution of the decree specifies the scope of the delegation:
- Competencies of the first vice president of the Provincial Council of Zamora.
- Competencies as delegated deputy for Education, Culture, Tourism, Emigration, and Artistic Heritage.
- Vice-presidency functions of the Provincial Tourism Board of Zamora.
The validity is set from October 5 to October 16, 2026, both dates inclusive, according to the second section of the decree.
Conditions, publicity, and appeals
The exercise of competencies is subject to the direction and supervision of the delegating body, and the administrative acts issued must expressly indicate that they are adopted by delegation. The general regime of revocation and avocations applies, although the avocation must be justified by technical, economic, social, legal, or territorial circumstances, such as emergencies, urgency, or unavoidable necessity. The decree specifies that delegations granted by the president cannot be revoked.
The third resolution orders that the measure be communicated to the affected deputies and to all administrative units of the institution, published in the Official Gazette of the Province, and reported to the Plenary at the first session it holds. Against the act, which exhausts administrative remedies, an optional appeal for reversal may be filed before the same body within one month or, directly, a contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Zamora within two months.
The impact of the measure is twofold: it guarantees the continuity of provincial management for eleven days in sensitive areas such as Education, Culture, and Tourism, and temporarily transfers to Emilio Fernández Martínez the representation in the Provincial Tourism Board of Zamora, a key body for the promotion of the province. The publication in the official gazette confirms that the substitution has been in effect since October 5.
