The president of the Provincial Council of Zamora, Javier Faúndez Domínguez, has appointed David Luis Vega Hidalgo as a career civil servant to the position of cook for the institution, included in the 2021 public employment offer. The decision was adopted via decree number 2026-6752, dated October 7, and published in the Official Gazette of the Province of Zamora number 122, dated October 16, 2026, in section III. Local Administration (official reference R-202602394). The appointment concludes a selection process opened in 2023 and entails the termination of the interim civil servant who had been occupying the position.
A selection process initiated in 2023
The call for applications dates back to presidency decree number 2023-3132, dated May 8, 2023, subsequently rectified by decree 2023-3303, dated May 12, 2023. The process was aimed at filling, via career civil servants, a cook position within the special administration scale, Special Services sub-scale, trades personnel class, group C, subgroup C2.
On April 29, 2026, the agreement of the qualifying tribunal was published on the entity’s electronic headquarters, containing the appointment proposal for the candidate who had passed the tests. Subsequently, decree number 2026-4010, dated June 26, 2026, published in the Official Gazette of the Province of Zamora number 77, dated July 3, 2026, approved the final list of candidates who passed the process, offered the positions to be filled, and granted a period of twenty business days to submit the documentation required in the rules.
According to the report accompanying the resolution, the candidate has already submitted the required documents and has opted for the offered positions, as recorded in the administrative file. The vacancy and the position are unoccupied by a career civil servant and have adequate and sufficient budgetary allocation.
The awarded position and its conditions
The destination awarded on a permanent basis, equivalent for all purposes to those obtained by competition, is as follows:
- Position: cook, job position list (RPT) code 239.
- Assignment unit: Residencia Virgen del Canto, General Services.
- Municipality: Toro (Zamora).
- Destination supplement level: 17.
- Provision method: competition.
- Group and subgroup: C2.
- Functions: culinary transformation of food and its distribution, applying general hygiene measures, preparation of consumption reports based on forecasts, and shift work.
- Requirement: food handler’s certificate.
Termination of the interim and taking office
The regulated filling of the position requires the ex officio formalization of the termination of the interim relationship, in accordance with Article 10.4 of the revised text of the Law of the Basic Statute of the Public Employee. The affected interim official is María del Carmen Vaquero Hernández, assigned to the same RPT code 239 of the Residencia Virgen del Canto, in General Services.
The assumption of office must take place before the president of the Provincial Council of Zamora within one month starting from the day following the publication of the appointment in the Official Gazette of the Province of Zamora. Once this period has elapsed without justified cause, the candidate will lose all rights acquired during the selection process. Before taking office, they must take an oath or promise to abide by the Constitution and the Statute of Autonomy of Castilla y León, and present the declaration of incompatibilities provided for in Law 53/1984, of December 26.
Appeals and regulatory framework
The agreement ends the administrative route. The following may be filed against it:
- Optional appeal for reversal before the same body, within one month from the day following its publication.
- Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Zamora, within two months.
- If an appeal for reversal is filed and is not resolved within one month, it will be understood as dismissed, and the contentious-administrative route may be pursued within six months.
The resolution invokes, among other regulations, the twelfth basis of the selection process, articles 18.5 of Law 30/1984, 25 of Royal Decree 364/1995 and 7 of Royal Decree 896/1991, article 135 of Legislative Royal Decree 781/1986 and article 34.1.h of Law 7/1985, regulating the Bases of the Local Regime, which grants the president the competence to make the appointment.
The appointment consolidates the staff of the Provincial Council of Zamora in a care service such as the Residencia Virgen del Canto in Toro, where the continuity of trade personnel is decisive for the daily care of the residents. The resolution thus closes a file that has lasted more than three years since the initial call and clears the administrative situation of both the new official and the interim worker who ceases in their position.
