The Provincial Council of Toledo appoints a head for its internal information system

The Presidency of the Provincial Council of Toledo has appointed Jesús Prieto Sabugo, Acting Secretary General of the corporation, as the Head of the Internal Information System provided for in Law 2/2023, of February 20, regulating the protection of persons who report regulatory infringements and the fight against corruption. The decision is adopted by Presidency Decree number 1621/2026, of September 16, and is published in the Official Gazette of the province of Toledo number 180, of Monday, September 21, 2026, page 3, with insertion number No. I.-4249 and verification code 2026.00004249. The appointment defines who assumes the management of internal complaints within the provincial institution, its autonomous bodies, and its attached instrumental entities.

The legal framework of the appointment

The decree is based on Article 8 of Law 2/2023, which grants the governing body of each obligated entity the competence to appoint the natural person responsible for the management of the system, as well as for their removal or termination. The resolution also invokes the powers conferred upon the Presidency by Article 34.1 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and is adopted “in view of the circumstances, and based on reasons of opportunity and convenience.”

The text recalls that the system was already implemented in the Council: by Presidency Decree number 1153/2026, of July 2, published in the Official Gazette of the province of Toledo number 126, of July 7, 2026, the implementation of the Internal Information System and the procedure for the management of information derived from Law 2/2023 was approved.

Requirements and scope of application

Article 8.1 of Decree 1153/2026 established that the person responsible for the system would, in all cases, be a public official in the service of the Provincial Corporation, with the possibility of delegating the system management and investigation file processing powers to one or more officials of subgroup A1.

The scope of the appointment covers:

• The Provincial Council of Toledo.
• Its autonomous bodies.
• Its attached instrumental entities.

The decree consists of three operative sections:

• First: to appoint Jesús Prieto Sabugo as Head of the Internal Information System under Law 2/2023.
• Second: to report the resolution to the Plenary of the Provincial Council in the next ordinary session, in accordance with Article 62 of Royal Decree 2568/1986, of November 28, which approves the Regulation of Organization, Operation, and Legal Regime of Local Entities.
• Third: to notify the interested party of the resolution.

Deadlines and means of appeal

This resolution exhausts all administrative remedies. An optional motion for reconsideration may be filed before the same body that issued it within one month, counting from the day following its publication in the Official Gazette of the province of Toledo, or a contentious-administrative appeal may be filed directly within two months before the Contentious-Administrative Courts of the city of Toledo.

The legal basis for this section is supported by Article 52 of Law 7/1985, of April 2, and Articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The announcement is signed in Toledo on September 18, 2026, by the President, Mª Concepción Cedillo Tardío, and by the Acting Secretary General, Jesús Prieto Sabugo, and is published “for general knowledge.”

The appointment completes the institutional design of the Provincial Council’s whistleblowing channel and allows public employees, citizens, and linked entities to know to whom information regarding irregularities should be channeled. By falling under the Acting Secretary General, the system is placed under a technical-legal profile of enabled rank, with the possibility of delegating the investigation of files to officials of subgroup A1, which reinforces the confidentiality and the separation between management and political decision-making required by Law 2/2023.
