The Provincial Council of Álava appoints an additional technical architect following a leave of absence

The Provincial Council of Álava has appointed Mikel Fernández de Labastida Gómez as a career civil servant in the special administration scale, technical sub-scale, medium technical class, technical architect, group A, subgroup A2, assigned to the position of Medium-Level Cadastre Technician. The appointment is formalized through Provincial Order 481/2026, dated September 29, published in the Official Gazette of the Historical Territory of Álava (BOTHÁ) number 115, dated October 7, 2026, in section I, with the official reference 2026-02816.

This is an additional appointment: the vacancy is filled by the next candidate on the final definitive list, after one of the four people appointed in July entered a status of voluntary leave of absence without reservation of the position.

Background: from the 2024 bases to the July leave of absence

The selection process began with the bases approved by Provincial Order 671/2024, dated December 18, which established the general bases for the selection processes corresponding to the 2021, 2022, and 2023 employment offers of the Provincial Council of Álava for admission as career civil servants. The specific bases for this call were approved by Provincial Order 676/2024, also dated December 18, for admission to the special administration scale, technical sub-scale, medium technical class, technical architect, classification subgroup A2, corresponding to the 2022 public employment offer.

Once the selection process was concluded and the qualifying tribunal made the appointment proposal for the candidates who passed, Provincial Order 354/2026, dated July 9, appointed the first four candidates from the final definitive list as career civil servants. Shortly thereafter, Provincial Order 368/2026, dated July 14, arranged for the granting of voluntary leave of absence without reservation of the position for one of those four people.

This effective resignation from the position is what now necessitates drawing from the list and additionally appointing the next candidate who passed the process.

Destination and nature of the position

The appointment is specified for a single destination, assigned to the position identified with code 1222.001:

• Appointed person: Mikel Fernández de Labastida Gómez.
• Position code: 1222.001.
• Denomination: Katastroko Erdi Mailako Teknikaria / Medium-Level Cadastre Technician.
• Scale: special administration, technical sub-scale, medium technical class, technical architect.
• Group and subgroup: group A, subgroup A2.
• Call: 2022 public employment offer.

The provincial order specifies that the assignment of newly recruited civil servants to the awarded position will be permanent and will be considered, for all purposes, as obtained through the system to which the provision of the position is reserved.

Assumption of Office on October 13 and Appeals Process

The appointed person must assume the awarded position on October 13, 2026. Those who fail to do so by the established date, except in cases of force majeure, shall lose the rights derived from the call for the acquisition of civil servant status at the Provincial Council of Álava.

This resolution is issued under Foral Decree 154/1993, of the Council of Deputies of July 30, which establishes the powers regarding public service; Foral Decree 29/2025, of July 29, which approves the organic and functional structure of the Department of Employment, Trade, Tourism, and Foral Administration; and Decree 150/2023, of the General Deputy, of June 30, which determines the departments of the Provincial Council of Álava for the 2023-2027 legislature.

An administrative-law appeal (recurso contencioso-administrativo) may be filed against the foral order within two months before the Administrative-Law Section of the Court of First Instance of Vitoria-Gasteiz, or optionally, a request for reversal (recurso de reposición) within one month before the same body that issued the resolution, in accordance with Article 46.1 of Law 29/1998, of July 13, regulating the Administrative-Law Jurisdiction, in relation to Article 123 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The order is signed in Vitoria-Gasteiz on September 29, 2026, by Cristina González Calvar, First Deputy General Deputy and Foral Deputy for Employment, Trade, Tourism, and Foral Administration.

Impact

The appointment provisionally closes the 2022 public employment offer process for the technical architect scale and ensures the coverage of the position of Middle Cadastre Technician, a sensitive area for tax management and the inventory of assets in the territory. For candidates who remain on the final definitive list, the occupied position is no longer available, although the definitive nature of the assignment does not prevent future leaves of absence or vacancies from reactivating the additional appointment mechanism.
