The Provincial Council of Cáceres assumes urban planning discipline for four municipalities

The Provincial Council of Cáceres has accepted the delegation of municipal powers for inspection, protection of legality, and urban planning sanctions from four municipalities in the province, thereby centralizing provincial urban planning control. The decision is published in the Official Gazette of the Province of Cáceres dated August 25, 2026, in Section I of Local Administration, through announcements BOP-2026-4001 and BOP-2026-4002.

The legal framework is established by the thirteenth additional provision of Law 11/2018, of December 21, on Sustainable Territorial and Urban Planning of Extremadura (LOTUS), introduced by Law 5/2022, of November 25. This regulation allows Extremaduran municipalities to delegate the exercise of urban inspection, the protection of legality, and sanctioning powers to their Provincial Council, provided that the delegation is accepted by the provincial Plenary and published in the official gazette.

A model agreement approved in 2025

On March 27, 2025, the Plenary of the Provincial Council of Cáceres unanimously approved the model inter-administrative agreement to formalize these delegations, aimed at municipalities with fewer than twenty thousand inhabitants. On this basis, the city councils have agreed to their adhesion in their respective plenaries:

• Jarandilla de la Vera, plenary agreement of June 24, 2026.
• Robledillo de Gata, plenary agreement of February 20, 2026.
• Torreorgaz, plenary agreement of July 3, 2026.
• Gargüera, whose agreement is signed with the Provincial Council and takes effect with this publication.

The agreement with Gargüera

Announcement BOP-2026-4001 contains the full text of the agreement signed between the City Council of Gargüera and the Provincial Council of Cáceres, signed in Cáceres on August 18, 2026. The Provincial Council is represented by its president, Miguel Ángel Morales Sánchez, assisted by the general secretary, José Álvaro Casas Avilés; the municipality is represented by the mayor-president Feliciana Muñoz Fernández. The agreement excludes from the delegation the inspection linked to ordinary urban planning control and the restoration of legality through legalization, which remain the responsibility of the city council.

Validity and economic distribution

The agreement has a validity of five years, extendable by unanimous agreements for periods of up to four additional years. Regarding the sanctions collected by the Autonomous Collection Body (OARGT), the distribution per case is 60% for the Provincial Council and 40% for the delegating city council. Legal defense in contentious proceedings is the responsibility of the Legal Office of the Provincial Council, and a Management and Monitoring Commission is created to oversee the execution of the agreement.

The centralization of urban planning discipline in the Provincial Council of Cáceres strengthens the capacity of small municipalities to address urban planning infractions by providing them with technical, legal, and collection resources that they lack individually. The measure, which already extends to four localities, lays the foundations for homogeneous urban planning control throughout the province.
