La DGPEM declara utilidad pública la planta fotovoltaica Vega Solar en Guadalajara

The General Directorate of Energy Policy and Mines (DGPEM), under the Ministry for the Ecological Transition and the Demographic Challenge, has granted Vega Solar, S.L.U. the declaration, specifically, of public utility for the Vega Solar photovoltaic plant, with 39.93 MW of installed capacity, and its evacuation infrastructure. The resolution, signed in Madrid on September 23, 2026, by the general director Manuel García Hernández, is published in the Official Gazette of the Province of Guadalajara number 186, dated September 30, 2026 (document 2026_2529). The recognition refers to the specific and individualized list of affected assets and rights included in the annex and enables the occupation of land and public easement zones.

The declaration is processed under Article 53.1 of Law 24/2013, of December 26, on the Electricity Sector, and Royal Decree 1955/2000, of December 1, which regulates the authorization procedures for electrical installations. The file, with code SGIISE/PFot-601, was initiated in the Industry and Energy Department of the Government Sub-delegation in Guadalajara and in the Functional Area of Industry and Energy of the Government Delegation in Madrid.

The process began in 2021: Vega Solar, S.L.U. requested prior administrative authorization on April 28, 2021, for a 37.5 MW plant, which was set at 34.98 MW by resolution of June 5, 2023 (BOE no. 142, of June 15, 2023). On July 18, 2023, the company requested modifications, construction authorization, and public utility; on November 15, 2023, it temporarily withdrew from the process, and on January 31, 2025, it reactivated it with 39.93 MW. The prior administrative authorization for the modifications and the administrative authorization for construction were granted by resolution of September 3, 2024 (BOE no. 302, of December 16, 2024).

Evacuation infrastructure shared with Acequia Solar

The resolution incorporates into file SGIISE/PFot-601 the public information procedures and consultations carried out in file SGIISE/PFot-602, associated with Acequia Solar, S.L.U., after agreeing on the transfer of ownership of part of its evacuation infrastructures.

  • The Taracena 30/220 kV transformer electrical substation, in the municipality of Guadalajara.
  • The 220 kV overhead-underground electrical evacuation lines between the Taracena SET and the Alcalá II Collector SE.
  • The expansion of the Colectora Alcalá II 220 kV substation, in Alcalá de Henares.

The transmission was agreed upon by resolution dated July 31, 2026, of the DGPEM, following a favorable report from the National Commission on Markets and Competition, maintaining the technical and environmental conditions of the previous authorizations. The promoter also signed shared-use agreements for evacuation infrastructure at the Alcalá II 220 kV and Cisneros 220 kV nodes with Acequia Solar, S.L.U., Alfanar Energía España, S.L., ES Planta Solar 3, S.L., Chapina Solar, S.L., Formentor Solar, S.L., Caravón Solar, S.L., Nortada Solar, S.L., Energías Fotovoltaicas Soluz, S.L., and Aton Fotovoltaicas, S.L.

Affected plots in seven municipalities

The annex of the resolution details the plots and cadastral references affected by the generating installation, the 30 kV underground line, the Taracena 30/220 kV substation, and the various sections of the 220 kV lines. The list is distributed among:

  • Tórtola de Henares, Guadalajara, Chiloeches, and Pozo de Guadalajara, in the province of Guadalajara.
  • Santorcaz, Los Santos de la Humosa, and Alcalá de Henares, in the Community of Madrid.

This list updates those published on June 16, 2025, in BOE no. 144; September 10, 2025, in BOE no. 218; May 29, 2025, in BOP de Guadalajara no. 102; September 12, 2025, in BOP de Guadalajara; and September 16, 2025, in BOCM no. 221.

Reports, allegations, and appeal process

  • Non-opposing responses were received from the Vice-Ministry of Culture and Sports of Castilla-La Mancha, the City Council of Pozo de Guadalajara, the General Directorate of Transport and Mobility of the Community of Madrid, and the Livestock Paths Area.
  • Technical conditions were established by the Tagus Hydrographic Confederation, Canal de Isabel II, S.A., Water Infrastructures of Castilla-La Mancha, the General Directorate of Biodiversity and Forest Management of Madrid, and the state, Manchegan, and Madrilenian general directorates of Roads.
  • The Public Business Land Entity communicated that a plot published in its name does not belong to it, therefore procedures were initiated to rectify the error before the Cadastre Management.
  • The request was submitted for public information in the BOE, the BOCM, the BOP de Guadalajara, the newspapers ABC and Nueva Alcarria, and the municipal notice boards; allegations were received and answered by the promoter.
  • Against the resolution, which does not end the administrative route, an administrative appeal (recurso de alzada) may be filed before the Secretary of State for Energy within one month.

The declaration of public utility is the step that allows the developer to request the authorizations for occupation of public domain and the necessary easements; therefore, the owners of the plots included in the annex are directly affected by the project. The file affects seven municipalities across two autonomous communities and adds to the concentration of photovoltaic installations and shared evacuation infrastructure in the Henares corridor.
