The Ministry of Justice reorganizes its central and territorial services

The Department of Justice, Transparency and Participation has approved Order 4/2026, of July 30, which develops Decree 40/2026, of March 13, of the Consell, approving the organic and functional Regulations of the department. The regulation, signed by the regional minister Nuria Martínez Sanchis, is published in the Official Gazette of the Generalitat Valenciana number 10446, of September 8, 2026, in section I of General Provisions, with reference DOGV-C-2026-28161.

The order regulates the administrative level of the department, determining the number, dependency, name, and functions of the units with the rank of general sub-directorate and service head. It replaces the previous Order 31/2025, of October 16, of the Department of Justice and Public Administration, which is hereby repealed, and enters into force the day following its publication.

Structure of the central services

The administrative level of the central services falls under the dependency of two regional secretariats and the Undersecretariat. The Regional Secretariat of Justice and Self-Government groups the General Directorate of Justice and Self-Government and the General Directorate of Victim Assistance and Access to Justice; the Regional Secretariat of Transparency and Participation integrates the General Directorate of Transparency and the General Directorate of Participation.

Within the General Directorate of Justice and Self-Government, several general sub-directorates are created:

• General Sub-Directorate of Human Resources of the Administration of Justice, with services for selection and provision, personnel, and occupational risk prevention.
• General Sub-Directorate of Transformation and Quality of the Public Justice Service, with services for planning and quality, digital transformation and administrative management, and training.
• General Sub-Directorate of Material Resources of the Administration of Justice.
• General Sub-Directorate of Judicial Infrastructures, which incorporates an engineering service for the energy transition of judicial headquarters.
• General Sub-Directorate of Concord and Promotion of Self-Government, with services for democratic concord and the promotion of self-government and Valencian foral law.

Victim assistance and data protection

The General Directorate of Victim Assistance and Access to Justice is structured into sub-directorates for assistance to victims of crime, access to justice and mediation, and legal entities. For its part, the General Directorate of Transparency incorporates the Technical Support Office for the Valencian Council for Transparency and the Conflict of Interest Control Office.

The regulation also governs the Data Protection Delegation of the Generalitat, which reports to the Undersecretariat and will have a delegate and five deputy delegates, with functions directed toward the areas of the Generalitat Administration, the instrumental public sector, the health sector, the educational sector, and the social services and equality sector.

Territorial Organization

As an expression of the principle of administrative decentralization, the department is organized into central services and territorial directorates with the rank of general sub-directorate and provincial-level competencies. There will be a territorial directorate in each of the capitals of the provinces of Alicante, Castellón, and Valencia, under the organic dependency of the Undersecretariat and the functional dependency of the general directorates according to the subject matter.

The territorial directorates of Alicante and Castellón will have a territorial secretariat with the rank of service, responsible for internal coordination, administrative, personnel, economic, and budgetary management, procurement, and the registration of documents.

Transitional Regime

The sole transitional provision establishes that the units and job positions configured according to the previous departmental structure will remain in existence, remunerated from the same budgetary credits, until the budgetary modifications and actions regarding job positions are carried out within the framework of the public service regulations. From the date of entry into force, changes in the assignment of units may occur as appropriate according to the reorganization carried out.

The reorganization affects the administrative organization of justice in the Valencian Community, with a direct impact on human resources management, judicial infrastructures, digital transformation, and victim assistance, as well as transparency and citizen participation.
