The Community of Madrid recognizes the conceived child as a member of the family

The Community of Madrid has approved Law 5/2026, of July 7, on the recognition of the conceived in the application of family support measures, which assimilates the unborn conceived to the already born child for the purposes of accessing family benefits and rights. The regulation, signed by President Isabel Díaz Ayuso, is published in the Official State Gazette (Boletín Oficial del Estado) number 213, of August 29, 2026, in section I of general provisions (p. 117275), with official reference BOE-A-2026-18283.
The law, approved by the Assembly of Madrid, is based on Article 39.1 of the Spanish Constitution, which enshrines the social, economic, and legal protection of the family, and on the Constitutional Court Ruling 271/2015, which endorses considering the conceived as already born in procedures within regional jurisdiction. It is framed within the Strategy for the protection of motherhood and fatherhood and the promotion of birth rates and reconciliation 2022-2026, whose measure 57 contemplates the consideration of the conceived as one more member of the family unit.
Assimilation of the conceived to the born child
The regulation establishes that, within the jurisdictional scope of the Community of Madrid, the conceived shall be considered born whenever the family unit or any of its members obtains a greater benefit. The assimilation shall operate with the scope and conditions regulated in each specific procedure and, as a general rule, a minimum week of gestation will not be required.
- In multiple gestations, each of the conceived shall be counted.
- If the conceived is not born, the Community of Madrid may not claim the return of the benefits already granted.
- Accreditation shall be made through a medical report issued within the five business days prior to the application, including the identification of the physician and their professional registration number.
Family assimilated to a large family
Article 4 regulates the status of family assimilated to a large family, which shall be directly applicable without further regulatory development. The certificate will be issued by the competent department for Family affairs, following an electronic application, and its validity will extend until three months after the expected date of delivery.
- Recognition will be carried out starting from the day following the completion of the 14th week of gestation.
- The resolution period will be one month, with positive administrative silence.
- The regulation extends to these families the tax benefits of articles 29, 32, and 38 ter of the consolidated text of ceded taxes.
Scope and entry into force
The law enables local entities of the Community of Madrid to apply assimilation within their jurisdiction, and the Governing Council to regulate the anticipation of the effects of guardianship, foster care, or the adoption of minors. The regulation will enter into force the day following its publication in the Official Gazette of the Community of Madrid (number 163, of July 10, 2026), except for the recognition of assimilated families as large families, which will do so in six months.
The measure consolidates a policy already applied in the region, such as the grants of 500 euros per month for pregnant mothers under 30 years of age or the inclusion of the conceived child in school dining grants. For readers, the regulation expands access to aid and tax benefits for Madrilenian families during gestation, and reopens the legal and social debate regarding the protection of the unborn within the autonomous scope.
