The ANA registers groundwater concession in Madriz for five years

The National Water Authority (ANA) registered in the National Public Registry of Water Rights and Service Providers the concession title authorizing Heberto Arturo Rivas Melgara to utilize 432.00 annual cubic meters of groundwater from the Finca Nueva Esperanza spring, in San Juan del Río Coco, department of Madriz. The registration certification, identified by reference RPNDAPS-LITC-ITC-0115-2026, is published in La Gaceta, Official Gazette No. 192 of October 20, 2026, under registration Reg. 2026-01010.

The act is based on Administrative Resolution No. RAE-ANA-DGRH-0151-2026, issued on August 27, 2026, and notified on October 5, 2026, which grants the right for a period of five years. The publication of the certification is the final step of the registration process and converts the title into a right enforceable against third parties within the registry administered by the ANA.

The scope of the granted right

The certification details the technical and legal conditions of the concession:

• Registered resolution: RAE-ANA-DGRH-0151-2026, “Concession title for the utilization of groundwater from one (01) spring, in favor of Heberto Arturo Rivas Melgara.”
• Validity: five (5) years starting from the moment of notification.
• Maximum annual utilization volume: 432.00 m³.
• Capture point: Finca Nueva Esperanza spring, in basin No. 64 “Río Coco”, municipality of San Juan del Río Coco, Madriz, UTM WGS84 coordinates 596459 E – 1496414 N.
• Authorized use: human consumption linked to commercial activity and agricultural/livestock.
• Registry entry: Perpetual Number 0115, folio 170, volume VII of the Concession Titles Registration Book.

Procedure, legal basis, and signature

The application was submitted on October 5, 2026, by the holder himself, identified with identity card 323-071177-0000L, for the purpose of registering the administrative resolution of the concession title. The National Public Registry of Water Rights acted based on Law No. 620, “General Law of National Waters,” published in La Gaceta, Official Gazette No. 169 of September 4, 2007, and Law No. 1046, “Reform Law to Law No. 620,” published in La Gaceta, Official Gazette No. 217 of November 23, 2020.

The Registrar also relied on Administrative Resolution No. 140-2019, “Appointment of the National Public Registrar of Water Rights,” issued on December 20, 2019. The Seventh Resolve of the registered resolution orders that the certification be published in La Gaceta, the Official Gazette, within a maximum period of fifteen calendar days. The certification was signed by Luis Fernando Yescas García, National Public Registry of Water Rights and Service Providers of the ANA, in Managua, at two forty in the afternoon on October 5, 2026.

The registration of the concession in favor of Rivas Melgara is important to water users and agricultural activity in San Juan del Río Coco, because it establishes in writing the available flow, the permitted use, and the term of the right, and allows verification that the capture of the Finca Nueva Esperanza spring is covered by a title registered and published in the Official Gazette.
