The ANA doubles the granted flow for Opportunity in Granada

The National Public Registry of Water Rights and Service Providers of the National Water Authority (ANA) has registered the modification of the groundwater concession title granted to Opportunity International Nicaragua, Inc, which increases the authorized volume at the “Pozo Opportunity” extraction point from 77,380.00 to 155,461.00 cubic meters per year. The decision is contained in Administrative Resolution No. RAE-ANA-DGRH-0156-2026, issued on September 2, 2026, and notified on September 29, 2026, and its registration certification is published in La Gaceta, Official Gazette No. 196 of Monday, October 26, 2026, under Reg. 2026-01048.

The legal framework of the registration

The certification is issued by the National Public Registry of Water Rights and Service Providers, an entity created by the provisions of Law No. 620, “General Law of National Waters,” published in La Gaceta, Official Gazette No. 169 on September 4, 2007, and amended by Law No. 1046, published in La Gaceta, Official Gazette No. 217 on November 23, 2020.

The appointment of the registrar is based on Administrative Resolution No. 140-2019, “Appointment of the National Public Registrar of Water Rights,” issued on December 20, 2019. The registration was recorded under Perpetual Number 0113, folios 166 and 167, Volume VII of the Concession Title Registration Book.

From 77,380 to 155,461 cubic meters per year

The Third Resolve of the registered resolution specifies the scope of the modification: the annual volume authorized at “Pozo Opportunity” was previously 77,380.00 m³ and shall henceforth be 155,461.00 m³, an increase of 78,081.00 m³, which is slightly more than double the originally conceded flow.

The technical and administrative conditions of the extraction point are as follows:

• Basin: No. 69, named “Río San Juan.”
• Location: municipality of Granada, department of Granada.
• UTM WGS84 Coordinates: 612446 E – 1317845 N.
• Authorized use: AGRICULTURAL.
• Original title: Administrative Resolution No. RAE-ANA-DGRH-0038-2023, issued on January 23, 2023, and registered on February 22, 2023, in Entry 0030, Folio 39, Volume IV of the Concession Title Registration Book.

The registration process and publication period

The application was submitted on September 29, 2026, by engineer Roxana Vanessa Martínez Izaguirre, acting as Special Representative Attorney for Opportunity International Nicaragua, Inc, a company constituted by Public Deed number 143 —English to Spanish translation of the association’s constitution and apostille— signed on May 27, 2014, before the notary offices of lawyer Federico Arturo Gurdián Sacasa.

Representation was accredited by Public Deed Testimony number 15, signed on June 18, 2026, before the notary offices of Isaac Daniel Tiffer Gutiérrez. The Sixth Ruling of the resolution orders that the certification be published in La Gaceta, Official Gazette, within a maximum period of fifteen calendar days.

The document was signed in Managua at twelve and two minutes p.m. on September 29, 2026, by Luis Fernando Yescas García, National Public Registry of Water Rights and Service Providers of the National Water Authority, and the certification was issued at twelve and seven minutes p.m. on that same date, at the request of Ms. María Del Socorro Soza Maltez.

The publication closes the administrative process and finalizes the new extraction volume, such that the concession registered in the public registry now reflects the expanded flow and not the one originally granted in 2023. For the municipality of Granada and the San Juan River basin, the entry sets the legal ceiling for groundwater utilization in that well for agricultural purposes at 155,461.00 m³ annually, a figure that any subsequent extraction control must take as a reference.
